When a defendant qualifies for the career offender enhancement under the U.S. Sentencing Guidelines, it often dominates plea negotiations due to the outsized sentencing exposure it entails. This article lays out a recent but deepening circuit split over the types of prior drug convictions that trigger the enhancement and explains how the split is likely to be resolved by re-examining the proper type and level of deference sentencing courts are to afford the Sentencing Commission’s interpretation of its sentencing guidelines.
The FCBA’s Fifth Annual Essay Contest has received 41 entries from high school students across the Northern District. High schools represented this year include Guilderland High School in Albany County, South Glens Falls Senior High School in Saratoga County, Fayetteville-Manlius and Jamesville-DeWitt High Schools in Onondaga County, and Tyburn Academy in Cayuga County.
