CA Coastal Commission Update
In recent communication with the CA Coastal Commission (CCC), we were advised that Dana Point Harbor Partners is not in compliance with several of the postconditions of the Coastal Development Permit. To name a few, DPHP has not filed progress reports, annual reports, nor a report on the underserved youth program, which was supposed to have started in 2022.
Please note, these non-compliance issues have not been elevated to enforcement at CCC, and obviously, they hope not to have to do so.
On the other hand, the lack of compliance by DPHP regarding the Day Use Boater Parking is being reviewed by enforcement. Once we know the outcome, you will be the first to know.
When we asked CCC for an update on dredging, they indicated DPHP had indicated it wasn’t their responsibility. We forwarded a copy of Exhibit A-3 from the Master Lease and the Second Amendment to the Master Lease to CCC. CCC has committed to getting us answers to our dredging questions. We will forward the response as soon as we have it. With construction starting in the Marina, we pose the question, could dredging be postponed for five years or longer?
