NLBMDA submitted written comments to the House Committee on Education and Labor for a hearing today with U.S. Department of Labor Secretary Marty Walsh. The hearing focused on the Biden administration’s labor policies and priorities under the new leadership of Secretary Walsh. As the national voice of the lumber and building material (LBM) dealer industry, NLBMDA outlined its positions to the committee and Secretary Walsh on a number of critical labor regulations and legislation that have a significant impact on dealers across the United States.
NLBMDA strongly believes these priorities will strengthen the LBM industry and result in mutually beneficial outcomes for both employers and workers. NLBMDA will continue to follow up with the Department of Labor and House Committee on Education and Labor on these key industry priorities.
Summary of NLBMDA Comments:

Material Delivery Exemption: Protect the material delivery exemption in the 2010 Cranes and Derricks in Construction rule and rescind the 2016 Letter of Interpretation which incorrectly contradicts the original rule.

Independent Contractor Rule: Preserve the major provisions of the Trump administration’s final rule clarifying the definition of employee under the Fair Labor Standards Act (FLSA).

Joint Employer Standard: Oppose the dramatic expansion of the traditional test for joint employer status in which a company must exercise “direct and immediate control” over an employment relationship.

Overtime Rule: Oppose any significant changes to DOL’s existing overtime rule.

Democracy in the Workplace: Reject the Protecting the Right to Organize (PRO) Act and any other legislation that would drastically alter the landscape of labor relations and have harmful effects on both employers and workers.

Minimum Wage: Oppose any increases to the federal minimum wage.

Supplemental Unemployment Insurance: Wind down the COVID-19 supplemental unemployment insurance program and reject any further extensions.
