Legislation and Appropriations Updates

H.R. 305 Introduced for continuing appropriations for FY 2022 through Dec. 3, 2021. The Indian Health Service funding would be maintained at FY 2021 levels with an additional $24.4 million for staffing and operations of expanded, renovated, or opened facilities during FY 2021 and 2022. 


H.R. 5221 – The Urban Indian Health Confer Act - Introduced by Chair Raul M. Grijalva (D-AZ) to amend the Indian Health Care Improvement Act to require the Department of Health and Human Services (HHS) to confer with urban Indian organizations. 


On Wednesday, Sep. 22, 2021, the House Veterans Affairs Subcommittee on Oversight and Investigations will hold a hearing entitled “Creating a Welcoming VA and Building Equity for Veterans through Legislation.” This hearing will include discussion of several bills, including H.R. 2385, the Justice for Women Veterans Act, and the VA Inclusion, Diversity, Equity and Access Data Improvement Act. 

Administrative and Regulatory Updates

Office of Management and Budget (OMB) Tribal Consultation on FY 2023 President’s Budget. OMB announced tribal consultation on Sep. 23, 2021 at 11 am Pacific. OMB is requesting for feedback specifically on highest priority programs and activities for investment in FY 2023 budget, treatment of proposed program and activity funds in Budget Reconciliation and Infrastructure Investment and Jobs Act, technical assistance needs, options for mandatory funding for the Indian Health Service, and barriers to improvement of water infrastructure.


HHS Consultation on Access to Supplies from Federal Partners. The HHS Office of the Assistant Secretary for Preparedness and Response (ASPR) announced tribal consultation on Oct. 18 from 11-1 pm Pacific and Oct. 20 from 11-1 pm Pacific. The consultation is intended to gather input and recommendations to facilitate access by Tribes, tribal health programs, IHS providers, and urban Indian organizations to medical countermeasures and supplies needed in a public health emergency.


Indian Health Service (IHS) Tribal Consultation on Designating Arizona as a Purchased/Referred Care Delivery Area (PRCDA). On Aug. 20, 2021, IHS announced tribal consultation on the multi-year feasibility study results for designation the entire state of Arizona as a Purchased/Referred Care Delivery Area. Tribal consultation sessions scheduled for September will be rescheduled at a later time.


HRSA Announces 60 Day Grace Period for Provider Relief Funds (PRF). For Reporting Period 1 (deadline of Sep. 30, 2021), HRSA will not initiate recoupment or other enforcement actions from Oct. 1- Nov. 30, 2021 to allow providers an additional 60 days to submit their report on the PRF Reporting Portal.  


HRSA Annual Tribal ConsultationHRSA announced their annual tribal consultation will be held in conjunction with the National Indian Health Board’s National Tribal Health Conference on Oct. 8, 2021 at 8 am Pacific. 


Upcoming Audit of Medicare Part B Opioid Use Disorder Treatment Services Provided by Opioid Treatment Programs (OTP). HHS Office of Inspector General (OIG) has announced an audit of Medicare claims for OUD treatment provided by nonresidential OTPs. The expected issue date is FY 2023. 


Department of Treasury Homeowner Assistance Fund (HAF). The HAF provides $498 million for Tribes and Tribally designated housing entities to prevent mortgage delinquencies and defaults, foreclosures, loss of utilities or home energy services, and displacement of homeowners experiencing financial hardship after Jan. 21, 2020.
