This year, the Nebraska Legislature advanced LB 935, which was signed into law by Governor Jim Pillen on April 14, 2026. LB 935, prioritized by the Judiciary Committee, included provisions from LB 1139, legislation introduced by Senator Robert Hallstrom on behalf of the Nebraska REALTORS® Association.
LB 1139 allows a current child support or spousal support payment history from the Department of Health and Human Services showing that all payments are current, and have been made as ordered for either the previous twelve-month period or the total time the order has been in effect, whichever is shorter, to serve as evidence that the payments are current. This evidence may then operate to release the lien for purposes of transferring a specific parcel of real property.
The Nebraska REALTORS® Association and the Nebraska Land Title Association supported this important change to align Nebraska with practices in surrounding states and eliminate unnecessary expense and delays for Nebraskans selling their property. LB 1139 was a commonsense cleanup measure that improves efficiency in real estate transactions while maintaining protections for support obligations.
