NYSRA Update: COVID-19 Outbreak | May 26, 2020

Federal
The IFR did not:
  • Extend the eight-week covered period for forgivable PPP loans.
  • Adjust the 25% limit on non-payroll expenses that are forgivable, nor
  • Address the two-year loan terms for those PPP loan amounts that are not forgiven.
The IFR does now:
  • Require employers to inform the State Unemployment Insurance agency of the employee's "rejected offer of reemployment within 30 days" of the rejection (pages 14 – 15).
  • Interim Final Rule on Loan Review Procedures and Related Borrower Responsibilities (Released May 22, 2020)

  • On Wednesday, House lawmakers will vote to pass H.R. 8668 that will make significant changes to the Paycheck Protection Program (PPP) including: 
  • Extending the period restaurants can use to spend federal loans.
  • Providing more flexibility in how the loans are used.
  • Extending the date that restaurants can bring their teams back to work.
While this new bill represents meaningful progress, our job is not done. We will be sending an action alert after the House bill passes asking members to begin contacting our Senators to encourage them to pass similar legislation.

State
  • Governor Cuomo announced that the Mid-Hudson region has met the required reopening criteria and today will begin Phase 1 of New York State’s reopening process. Long Island remains on track to begin Phase 1 tomorrow, May 27. 
  • The New York State Senate and Assembly resumed committee work today using technology to meet virtually.
  • NYSRA is a coalition partner of the Lawsuit Reform Alliance and today they sent out this action alert, Send a message to Governor Cuomo: Extend COVID 19 Liability Protections to Businesses and Non-Profit Organizations!
 
  NYC
  • Thanks in large part to NYSRA and our member advocacy, a package of business relief proposals was approved by Mayor de Blasio today.
  • The new law prohibiting the enforcement of personal liability in commercial leases takes effect immediately.
  • The new law waiving and refunding sidewalk cafe fees will take effect immediately.
  • The law limiting fees charged by third-party ordering platforms will take effect in seven days (June 3). 
We are proud to have supported these new laws through the legislative process, and especially for third party platforms, to have brought these issues to the forefront of policy discussion. We are glad to be putting money back in the pockets of our members, who despite every challenge, are open for takeout and delivery. We will continue to fight for your businesses in New York City. 

Nassau County
  • Nassau County announced that it will offer $500,000 in loans to help small businesses, nonprofits and landlords struggling during the coronavirus pandemic in a bid to distribute up to $10 million to the entities from a new state lending program. Entities that received funding through the Paycheck Protection Program, or an Economic Injury Disaster Loan, are not eligible for the state's lending program. https://nwsdy.li/2LWloET
