New Federal Laws Protect the Rights of Pregnant, Postpartum, and Lactating Workers | |
In 2022, two new federal laws were passed that help protect the rights of millions of pregnant, birthing, and lactating employees nationwide. In California, these rights are even stronger, and some locations in California (including San Francisco) provide additional rights and protections. Employees should be sure to find out what their rights are, and what they can do if they believe they have been denied their rights. |
Under the “PUMP” Act for Nursing Mothers, which went into effect on December 29, 2022 (with full remedies provisions added as of April 28, 2023), almost all lactating employees now have the right to break time and a private, non-bathroom space to express milk for one year after the birth of their child. The previous federal lactation accommodation law, passed as part of the Affordable Care Act in 2010, extended this right only to “non-exempt” workers (generally, this means those who are paid hourly). Here in California, we’ve had these rights – and more (including no time limit after the child’s birth) – for every employee for over 20 years!
|
The Pregnant Workers Fairness Act (PWFA), which went into effect on June 27, 2023, requires employers with over 15 employees to provide reasonable accommodations during pregnancy and postpartum; in California, similar laws were already in place for employers with FIVE or more employees. While the PWFA permits some smaller employers to request an exemption on the basis of “undue hardship,” California law provides no such exemption.
Please share this information and related resources with those you serve, and within your communities and networks, so all employees know their rights. Click HERE for additional information and resources.
