Using a Drug Recognition Expert

Post-Incident Review to

Prosecute a Driving Under the Influence Case

Beginning in 2018, the Orange County District Attorney's Office received a grant from the California Office of Traffic Safety (OTS) to bring prosecutors and DREs together to collaborate in the prosecution of driving under the influence cases. DRE post-incident reviews have become a cornerstone of this successful program. Under the OTS grant program, DRE post-incident reviews have been used over 100 times in jury trials. This presentation by a prosecutor and DRE instructor experienced in the use of DRE post-incident reviews in trial will use post-incident reviews case studies to present the lessons that have learned about this tool. This course is for both DREs and prosecutors so they can successfully use this tool in DUI cases.


This session is designed for Prosecutors, Agency Legal Advisors and any LEO or Toxicologist that deals with DUI/Traffic Enforcement.
