New COVID Executive Order: Updated Requirements for all Businesses and Entities

On Friday, Gov. Eric Holcomb signed Executive Order 20-48 replacing the previous five-stage reopen plan launched in May, and it is in effect until at least December 12. Key requirements for businesses:

  • all businesses, including non-profits, must place clearly visible signage at their public and employee entrances, notifying that face coverings are required for entrance (sec. 4-b);
  • businesses shall require employees to wear face coverings (sec. 4-b);
  • all businesses and entities continuing or resuming operations are required to develop a plan to implement health and safety measures and safeguards for employees, clients, and the public; this plan is to be shared with employees and posted publicly (sec. 4-a);
  • all businesses and entities must take proactive measures to ensure compliance with the social distancing and sanitation requirements of the order (sec. 4-c);
  • all events and gatherings are limited in size based on your county’s color coded rating; local health departments can approve or decline petitions for exception submitted by the host (sec. 7), and;
  • the event limit provision does not apply to internal business meetings held within a business’ own facility (sec. 7-d).

The order also requires every individual in Indiana to wear face coverings over their nose and mouth while inside a business or public place, except when working in a private office / workspace or in meetings when 6 feet of distance can be achieved; other exceptions apply (sec. 3e-f).

Businesses not complying with the order will receive a verbal warning, followed by a cease-and-desist order if the unsafe practice continues. If a business does not comply with the cease-and-desist order, the state may shut down operations and revoke business licenses and permitting.
