This is a reminder about the New York Tier II Reporting Requirements due in March each year.
TIER II REPORTING REQUIREMENTS - Who must report?
If you store, use or produce chemicals, requiring maintenance of Material Safety Data
Sheets (MSDS) under the Hazard Communication Standard, that are present in your
facility in excess of the appropriate threshold, and are not exempt under Title III, then
you must submit Section 311 and Section 312 (Tier II) reports.

New York State is strongly encouraging facilities to use E-Plan as the basic Tier II reporting methodology. By using E-Plan, those required to report will satisfy the Tier II submission to the State. The decision to accept online reporting to LEPCs and fire departments has been left up to each individual jurisdiction.
Completed Tier II forms are due by March 1, 2017. Petroleum marketers are required every year to report the identity, location, and quantity of hazardous materials. This includes heating oil, propane, and other fuels greater than 10,000 pounds (approximately 1,626 gallons). The fine for failing to report can be up to $37,500 per day, per violation.

Spring Meeting Content Update

Propane Safety - The Importance of Creating & Maintaining Policies and Procedures
, with Eric Leskinen, Executive Vice President, P3 Propane Safety, has been added to the programs for the 2017 Spring Conference and Annual Meeting at the end of March. An overview of this presentation follows:
An organization's Safety Policies and Procedures are the operational foundation for all its business processes. Clear policies define the business protocol and ensure that all employees operate according to a consistent prearranged formula. The scope of written policies includes language to cover legal issues that may arise due to the nature of the business, employee health and welfare, especially in hazardous operational conditions, and/or ethical concerns that may put the organization or the employee in a position of conflict. Procedures document the who, what, when and how of task performance. An individual procedure for a single task defines who is responsible for completion of the task, what steps are involved in the process, when each step is undertaken and how the progression of steps is performed to complete the procedure. The procedures manual, a collection of individual task procedures, forms the basic guiding document for the consistent completion of core responsibilities and is absolutely critical from a propane safety perspective. Attendees will learn why policies and procedures are important as well as fundamental techniques for creating and maintaining them.

Spring Meeting Legislative Reception - now on Monday Night March 27 |
In 2016 the NYPGA Spring Conference featured a Legislative Reception at the Fort Orange Club in downtown Albany. The event was a huge hit with over 100 propane industry leaders attending.
WE WILL REPEAT this event in 2017...
Note the event will occur on MONDAY NIGHT, March 27, at the Fort Orange Club in Albany. This is the night before the NYPGA Spring Conference begins on Tuesday. The registration link for the March 28-29 Spring Conference will be updated to show the proper date. NYPGA will also contact anyone that had signed up for the event before today to ensure they have the correct details.

Re-qualification of Cylinders |
DOT Cylinder Requalification
The start of the year brought about numerous alerts on the re-qualification of cylinders.
On January 24, 2017, the President of the United States issued an Executive Order requesting his appointees and designees to review new and pending regulations in the next 60 days. Therefore, the January 23, 2017 effective date for new requirements for re-qualification of specification cylinders has been temporarily postponed. Until further notice, the re-qualification date for specification cylinders will return to 12 years from the date of manufacture.
Prior to that Executive Order, the re-qualification period for DOT specification cylinders had changed. The Pipeline and Hazardous Materials Safety Administration (PHMSA) changed the re-qualification period for DOT specification cylinders detailed in 49 CFR 180.209(e) of the hazardous material regulations as follows:
- The initial re-qualification period for DOT cylinders following volumetric expansion testing changes from 12 years to 10 years;
- The re-qualification period for DOT cylinders following a proof pressure test changes from 7 years to 10 years.
NPGA staff are hard at work on this situation for the industry. NPGA actions to overturn this:
- Prior to the formal actions listed below, NPGA was in contact with PHMSA at the staff-level via phone and e-mail. NPGA attempted to pursue a staff to staff level change; however, when DOT failed to respond appropriately, NPGA began formal action.
- On January 13, 2017, NPGA filed a formal petition for a stay of the rule. The filing asserts PHMSA did not follow the prescribed legal process outlined in the Administrative Procedure Act, is inconsistent with previous PHMSA directions, and has negative consequences for small businesses and consumers. PHMSA has received the petition but has not formally responded to any inquiries.
- NPGA has highlighted to PHMSA the error in the agency's actions that implement these changes to DOT cylinder re-qualification requirements. The changes were part of a broader PHMSA rulemaking (HM-233F) that incorporated nearly 100 special permits into the federal hazardous materials regulations. Nowhere, in either the proposed rule or final rule, did PHMSA provide any rationale or substantiation for the changes or address them in any form.
- NPGA is having conversations with Members of Congress on the relevant oversight Committees and urging intervention. These conversations have been productive and has already resulted in Congressional communications to the agency regarding this issue.
- NPGA is working with the DOT Transition Team to determine whether this rule is included in the Executive Order to postpone the effective date of pending regulatory actions by 60 days.
- NPGA is working with PERC to update the relevant training and testing materials. Please contact Stuart Flatow for inquiries related to safety materials.

At the most recent NPGA Board of Directors meeting, this topic was discussed. Roadside inspections and relief valves on forklifts were other concerns discussed. It seems most marketers have already started moving towards at 10 year requalification timeline while others are taking advantage of the Executive Order and holding off.
