LSSM Helps Mother Fight Back Against Years of Housing Horrors

The stench was the first thing you noticed. It was an overwhelming odor of sewage that clung to everything from the basement to the rafters. Amber had grown grimly accustomed to it over the past six years, ever since she, her young son, and her elderly uncle moved into the rental home. For the first three years, it was a twice-weekly ordeal—the basement drain backing up like clockwork, spewing its contents across the floor. Then it got worse. The drain pipe from the house to the city line became completely blocked, turning the basement into a stagnant swamp of sewage. For three long years, they lived with the constant presence of raw waste.

Amber, a survivor of homelessness, was terrified of rocking the boat. This house, despite its flaws, was a refuge. She had meticulously documented each sewage backup with photos, desperately trying to manage the problem herself. She had even rigged a makeshift system to funnel the waste away from their belongings, a constant, pungent reminder of her landlord's negligence.

The landlord, unresponsive to her pleas, offered only temporary fixes that did nothing to address the root of the problem. The basement, once a potential play area for her son, was now a no-go zone, permanently submerged under six inches of raw sewage.

Amber’s search for alternative housing proved futile, and limited income and her uncle’s past eviction made finding a new landlord willing to take them in nearly impossible. She felt trapped, her family's health and well-being held hostage by a broken pipe and an indifferent landlord.

Then came the rent increase—an unexpected hike in the middle of their lease, a blatant violation of their agreement. Amber refused to pay. The landlord retaliated, suing her for possession. That's when she found Legal Services of Southern Missouri (LSSM).

LSSM fought back, winning the possession case and then taking on the landlord for the years of sewage neglect. Amber, hesitant at first, found her voice in the courtroom. Her testimony, raw and powerful, painted a vivid picture of life in a house drowning in sewage. The photographs, years of documented neglect, spoke for themselves.

After eleven long months, the judge ruled in Amber's favor. The landlord was ordered to pay $25,000, the maximum allowed in Associate Court. The judge recognized the years of uninhabitable conditions, essentially valuing the property at zero for the duration of the persistent sewage problem.

The victory was more than financial. For Amber, it was a validation, a recognition of the trauma she and her family endured. It was justice, hard-won, and long overdue. Though the landlord has yet to pay, Amber is pursuing every avenue to collect, determined to hold him accountable.

Amber's story is a testament to the power of perseverance and the importance of legal aid. It's a reminder that even in the face of overwhelming odds, a single voice, amplified by the right support, can make a difference.

Amber's story is a powerful reminder that everyone deserves a safe and healthy home. Legal Services of Southern Missouri fought tirelessly to protect Amber and her family, ensuring they received the justice they deserved. But there are countless others facing similar struggles.
