Mark Alexander: Three Historic SCOTUS Decisions on Liberty and Life
Democrats have not been this angry since Republicans freed their slaves, and those protesting for “women’s rights” today couldn’t define a woman yesterday.
There were three SCOTUS decisions last week — one on First Amendment religious freedom, one on the affirmation of Second Amendment freedom, and one on restoring protection for the most vulnerable and precious among us, babies before birth.
For those decisions, we owe a debt of gratitude to Sen. Mitch McConnell and former President Donald Trump, who paved the path to these decisions.
McConnell stood fast in 2016, refusing to allow Barack Obama’s leftist nominee, Merrick Garland, to go forward. With Garland now Joe Biden’s attorney general, we get a clear picture of how unqualified he was as a jurist.
For his part, Trump, as promised, nominated three of the nine Supreme Court members, which decisively moved the Court toward those who correctly advocate constitutional Rule of Law versus those who arrogantly and errantly advocate for the rule of men.
On the first decision, as Doug Andrews noted, “The High Court ruled in favor of religious freedom and school choice.” In a case that challenged the State of Maine from withholding funds from schools with religious curriculums, Chief Justice John Roberts wrote: “[The state] requires rural communities without public secondary schools to either sign contracts with nearby public schools or to pay tuition at a private school chosen by parents that is a 'nonsectarian school in accordance with the First Amendment of the United States Constitution.’” Roberts wrote in the majority opinion that while “a state need not subsidize private education,” “once a state decides to do so, it cannot disqualify some private schools solely because they are religious.”I met with faith-based school leaders a day later, and they indicated the decision could have far-reaching implications for funding of private and charter schools nationwide.

The Inconvenient Truth About COVID-19 Relief Scandals
Raise your hand if you’re surprised that the trillions of dollars spent on COVID-19 relief gave way to billions of dollars in government waste, fraud and abuses. I’m not, but based on recent reporting, you might think this type of carelessness with taxpayers’ money has never before happened. Sadly, such waste and fraud are normal byproducts of most government programs.
Too much focus on waste and fraud misses a more important problem: Lots of the COVID-19 spending that doesn’t qualify as wasteful or fraudulent was nonetheless misspent.
When the pandemic hit the United States in March 2020, people all over the country panicked. Everyone seemed to agree that the right thing to do was pump the nation full of as much money as possible, as fast as possible. As a result, nearly everyone—married, unmarried, employed, unemployed, through businesses small and large—got cash through the $2 trillion CARES Act.
Some people did raise the potential for fraud. We were told that there was no time to put in place measures sufficient to prevent it. However, the CARES Act did create an oversight mechanism called the Pandemic Response Accountability Committee. The committee had a difficult task due to the enormous size of the relief bill, a hardship compounded by the ....

From Airbnb to Zillow, You Subsidize Abortion When You Patronize These Companies
At the end of last summer, as the Texas heartbeat bill took effect, corporations began to assure their affected employees that travel expenses incurred while procuring abortions would be covered. This trend accelerated after the May leak of the draft SCOTUS opinion in Dobbs v. Jackson. Now, you get to pay an abortion subsidy “tax” every time you shop for many goods and services.
I’ve been irked since the ’90s, when Big PR decided consumers preferred to spend their money at companies that undertook “social responsibility.” Not me — I’d rather pay five bucks less for that dress than bask in the virtuous glow of knowing I’d been coerced into funding the purchase and planting of a sapling or the rehabilitation of a gimpy sea turtle, or whatever. When I want to shop, I want to shop; when I want to donate to charity, I want to donate to a charity that I choose. Why should corporations force me to subsidize their favorite woke causes every time I do business with them?
But after the Dobbs decision, companies are in a lather to promote abortion — and consequently, there’s an employee abortion-travel premium built into their pricing.

One Uvalde Responder Showed What Real Masculinity Is
It was the last conversation they would ever have. On May 24, sometime between 11:44 a.m. and 12:50 p.m., 44-year-old Eva Mireles called her husband, Ruben Ruiz, and told him “she had been shot and was dying,” in the words of Texas Department of Public Safety Director Colonel Steven McCraw, who testified at a Texas Senate hearing on June 21. No one knows what else passed in that last, private moment between husband and wife—were there tears? Did he say, “I love you?” Did they recall their favorite memory?—and it’s best to leave it that way.
“And what happened to him, is he tried to move forward into the hallway,” narrated McCraw. “He was detained, and they took his gun away from him and escorted him off the scene.”

Devastating Updates From Uvalde
The horrific shooting at Robb Elementary School in Uvalde, Texas, is the stuff of nightmares. The shooter was able to breech the school through an unlocked back door and carry out his evil intentions on 19 defenseless children and two teachers. The heartache and deep anger that accompanies such evil acts is almost impossible to bear because, even though the evildoer is dead, the devastation he left in his wake cannot be undone.
Sadly, his actions are not the only ones that need to be addressed.
The Uvalde Police Department’s actions were under scrupulous review after several details emerged about the active shooter situation. The police station is not far away from the school, and yet the shooter was permitted to massacre his victims over the course.....

The Return To Constitutionalism Is Hidden In Plain Sight
The Supreme Court has just released two monumental decisions. Predictable responses have ensued from the expected interested parties. And the widely publicized legal analysis goes something like this
Bruen overturned New York’s century-old Sullivan Law. The Court held that the Second Amendment requires that states must allow law-abiding citizens to carry firearms, with the possible exception of courthouses and other “sensitive” locations. High population density does not make Manhattan a sensitive location. Thus, New York can ban either open or concealed carry, but not both. And New York (and DC, HI, MD, MA, NJ, etc.) cannot demand that a citizen demonstrate “proper cause.” Carrying arms is a right, not a privilege.
Dobbs overturned Roe v Wade. Basically, there is no right to abortion in the Constitution. Never was. It’s an issue for the states to handle.
Beyond these bare declarations of final conclusions lies a cornucopia of incredibly important legal foundations. And those foundations may, once and for all (near future) time, severely restrict the various federal District Courts of Appeals from twisting into pretzels to avoid the plain meaning of the Constitution. The first is a direct slap in the face of the Ninth Circus, the Amber Alert poster child for Missing Legal Reasoning.
Leftist Courts (yes, Justice Roberts, they do exist…) typically do a legal two-step dance to get to the decisions they want. First, (see McDougall v. County of Ventura) they happily admit that the particular law is contrary to the Constitution. Then, contrary to Heller, they adopt a second step that “balances” the interests of the state against the rights of the citizen. This balancing act is infinitely malleable and provides no prior standard for what the state can and cannot do. In short, it becomes a way for tyrants to “pass legal muster.” Bruen shuts this door:

Experimental Wargaming at the Tactical Level: An Example
.
Examples of wargaming at the tactical level are scarce in the military literature and army manuals (Hodge, 2012). Courses of action are tested at the strategic and operational level using a paradigm based on a three-legged stool for “What If” analysis: computer simulation, experimentation, and wargaming (Alberts & Hayes, 2002). The legs of the stool represent different approaches to What If analysis that are useful in different situations. Unfortunately, this paradigm might become limiting as the legs turn into silos. The purpose of this paper is to demonstrate that tactical wargaming is feasible by crossing the barriers between simulation, wargaming and experimentation. Fair warning: this demonstration involves dice despite objections to their use in military wargaming (Guyer, Rovzar, & Sprang, 2021).

A First Circuit Decision and the Future of Telephone Pole Camera Surveillance
Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) agents suspected that Nia Moore-Bush was involved in illegal drug and firearm sales. So, without obtaining a warrant, they mounted a sophisticated camera on a telephone pole and surveilled her Massachusetts home for eight months in 2017. The camera recorded the front part of Moore-Bush’s house and yard and her full driveway, day and night. It could zoom in to capture facial expressions, small objects in a person’s hands, details on clothing, license plates, and more. Over the course of eight months, it captured her comings, goings, guests, and activities in the front curtilage of the residence, which ranged from the mundane to the personal to the potentially incriminating. And ultimately, it helped law enforcement make their arrest.
Moore-Bush’s motion to suppress this....
