Onerous Rec Area Requirements Move Forward in OV
Despite concerns expressed by SAHBA (click here to review the letter), the Oro Valley Planning & Zoning Commission voted to recommend Town Council approve new requirements for recreational areas in private subdivisions. The proposal would effectively double the amount of builder provided park space in a subdivision. This would reduce the number of homes that could be built. In addition, the proposal would significantly increase the amenities that would be required in the parks and make it very expensive to build in the Town. SAHBA will continue to attempt to work with the Town to try and find a reasonable approach in finalizing the new requirements.

Judge Sides with County in Differential Rate Case
This week Superior Court Judge Randall H. Warner granted summary judgement in a ruling in favor of Pima County in its case against the City of Tucson for charging different rates for customers in unincorporated Pima County. The Judge determined the “differential rates” are not just and reasonable under Arizona Statute “because Tucson set the rates without basing them on any cost study, supply data, or cash flow projections.” By way of background, the Tucson Mayor & Council voted to raise rates only for customers in unincorporated County customers in December 2021. In response, the Pima County Board of Supervisors subsequently voted to sue the City. The Tucson Regional Water Coalition, of which SAHBA is a member, expressed concern about the differential rate proposal to both the Council and Board of Supervisors. The entire ruling can be found here.
