This March update from AHLA shares an important development regarding a legal challenge by Airbnb and HomeAway: According to Bloomberg News, Airbnb has lost "a major fight" in its legal battle to reverse the Santa Monica short-term rental decision passed last year. This decision will set an important precedent around the country as municipalities who have already passed short-term rental ordinances are facing threats of a lawsuit by Airbnb.

According to Bloomberg: "Airbnb Inc. and Expedia Group Inc.'s HomeAway failed to persuade a U.S. court of appeals to strike down a Santa Monica law that makes the companies liable for illicit rentals in the Southern California beach city. The ruling Wednesday by a panel of Ninth Circuit judges is a setback for the home-sharing platforms in their effort to avoid regulation by cities that blame the rapid proliferation of short-term rentals for a shortage of affordable housing and a disintegration of residential communities."

As you know, Santa Monica was one of the first cities to hold the platforms accountable for fostering illegal activity on their site to the detriment of the community and housing affordability. Efforts to regulate the platform were spearheaded by Lynn Mohrfeld at the California Hotel & Lodging Association, along with AHLA and a broad-based coalition of groups, including labor and affordable housing groups and neighborhood activists. In the coming days, we'll be sharing the details of the ruling with our partners - and city officials -- in markets around the country to ensure the implications of this decision reach far and wide.

PAII is very appreciative of this work done on behalf of the lodging industry that is 'playing by the rules'!


Two weeks ago, Booking.com launched a new brand marketing campaign in the United States, designed to showcase the site's breadth of choices and to encourage consumers to come directly to the site. Hmmm - not exactly the brand of "BOOK DIRECT" that the B&B/Innkeeping industry is promoting thru the "Join the Movement" campaign!

Booking Holdings spent $509 million on brand marketing in 2018 - up from $435 million in 2017 - and direct bookings (their version) now account for more than 50% of booked room nights on Booking.com. (from PhocusWire update 3-4-19)


A few weeks ago we announced a new section of paii.org which lists an abundance of resources for future innkeepers, as they investigate the innkeeping industry and develop their business plan. We just added the "Articles for Aspiring Innkeepers" booklet from Rick Newman, founder, Commercial Capital Network. Rick specializes in financing properties, AKA the inn of your dreams! I was invited to be interviewed for a 5-minute segment by Host Rudy Maxa, and talk about where do B&B/Inns fit in the plethora of lodging options, from the Marriotts to the Airbnbs. Those minutes FLEW by, and listeners (hopefully) now know that B&Bs invented the 'share economy' and specialize in being a personal concierge. I explained the difference between unregulated short-term-rentals, and lodging that abides by the regulations. And, finally, where to find the perfect B&B, and what questions to ask! It's like watching a duck glide on the lake - you don't see much movement, but there's plenty of action below the surface! Our industry's Book Direct Movement steering group has met, and will be meeting (electronically) with Team Leaders the first week in April, or before if schedules permit. As the Team Leader for Association Organization Team, look for a note from me that defines our task - which is primarily communicating the Book Direct message to Associations and assisting them to move that message along to innkeepers, the media, guests and the public.
