On April 24th, 2013, the U.S. Dept. of Ed., Office for Civil Rights sent a Dear Colleague Letter (DCL) reminding educational institutions (both K-12 and higher education) that Title IX strictly prohibits retaliation against an individual who engages in complaining, reporting, testifying or participating in an investigation or procedure related to behavior that would constitute a violation of Title IX. The DCL reinforces this by reminding funding recipients that failure to observe and comply with the non-retaliation will result in administrative action by the OCR, and/or referral to the Justice Department for judicial proceedings.
