Spotlight on SB19-108: Juvenile Justice Reform

CJDC's Policy Committee continues to monitor and review bills pending before the Colorado legislature.  As reviewed in our last newsletter, CJDC was asked to participate on the Improving Outcomes for Youth Task Force (IOYouth) , which was initiated by Governor Hickenlooper and led by Senators Pete Lee and Bob Gardner.  The task force was representative of the diverse constituencies that make up the state's juvenile justice system.
 
The product of the task force's work is embodied in SB19-108.  Among other things, the bill focuses on the following:
  • It would adopt an evidence-based tool to determine risk levels of juveniles entering the system; 
     
  • Which in turn would be used by the court at sentencing as well as the probation department and the Department of Youth Services when evaluating need for services.  
     
  • The bill would focus on diversion, requiring the use of an evidence-based screening tool and mandating the collection of data to inform future policy decisions. 
     
  • The bill would also develop and adopt an evidence-based detention screening tool.
     
  • This tool would ensure clear criteria for detention and allow detention in limited, enumerated circumstances.
This legislation came from the IOYouth Task Force, comprised of stakeholders across the juvenile justice system including CJDC.  While we would have liked to see a broader Juvenile Justice Reform Bill to address myriad other critical issues facing youth in the system, this compromise bill has potential to make important, incremental improvements.  It expands diversion programs statewide and limits detention and is aimed at ensuring consistency across jurisdictions, and moving the delinquency system toward evidence-based tools and assessments and away from ad-hoc, emotional arguments and rationales that inevitably lead to over-incarceration and system overreach.
 
The Bill passed out of the Senate Judiciary Committee unanimously (5-0) this week.  The Colorado District Attorney's Council provided the only testimony in opposition to the Bill, and those in support included the Colorado Office of the State Public Defender, the Division of Youth Services, the ACLU, the State Court Administrator's Office, the Office of the Child's Representative, the Parent Teacher Association, and others.  Next, the Bill moves to Appropriations.

How to Get a Client off the Registry CLE 

CJDC partnered with CCDB on February 13th to deliver a free CLE, "How to Get a Client off the Registry."  The CLE focused on the recent changes to the deregistration statute and the specific steps that must be taken to successfully file and litigate a deregistration petition.  CJDC continues to offer free legal help to juveniles to get off of the sex offender registry.  If you are interested in helping with CJDC's juvenile deregistration program, please contact Jeff Cuneo at Jeff@CJDC.org for more information.
