Greetings from Paul Bennett

It’s hard to believe that another school year has come to an end and that we’re again on the verge of summer. As always in Texas, this is a time of seasonal thunderstorms and severe weather that were extreme this year and sadly touched many. Our thoughts and prayers are with all of those who were affected, and we stand ready to assist our clients. But soon we’ll get to enjoy the fruits of summer.


In my family, that means a brief break from baseball tournaments and cheerleading competitions, with a season of Scout camps, sleepaway camps, and family time at the pool. And we’ll get to enjoy the searing heat too. Just kidding! We are hoping that this will be a mild summer, but I don’t want to jinx it. We sincerely hope that each and every one of you has a safe and happy start to your summer and, as always, we will be here when you need us.

The 2024 Texas Law Update Highlights!

This year, the Texas Law Update was an opportunity for old and new friends to gather together and take in legal updates in good company. With 8.0 CE credit hours approved by the Texas Board of Insurance, attendees covered 6 hours of general credits and 2 hours of ethics while enjoying good food, and the chance to win tickets to see the World Series Champion Texas Rangers in a raffle!


On April 19th, people came together at the DoubleTree by Hilton Hotel to listen to speakers cover a range of educational topics. These great topics presented by a captivating group of speakers can be requested for CE credit by contacting our Marketing Manager, Andrea Rose.

Summary Judgement VICTORY!

Paul Bennett and Alex Zasypayko recently obtained a summary judgment dismissing all claims against their client in a case pending in Dallas County. The client, a general contractor, was sued when a worker employed by a subcontractor sustained serious injuries while using a power saw at a construction site. Paul argued the motion to the court, citing a Dallas Court of Appeals’ opinion from a similar case he won some nine years ago. That case stood for the proposition that a general contractor could not be held liable for such an injury, absent evidence of actual or contractual control. The District Judge agreed that the evidence did not support a finding of liability against the general contractor under the law, and granted the motion in full, ordering that the Plaintiff take nothing. 

Summary Judgement Granted!

Fletcher Farley recently succeeded on a No Evidence Motion for Summary Judgment in Dallas County. We represented the manufacturer of a heating component in a personal injury case involving a stove and a burn injury. After numerous expert inspections of the physical evidence recovered from the scene of Plaintiff’s injury, including the heating component manufactured by our client, there was no evidence found that the heating component malfunctioned or failed in any way. As such, we filed a Motion for Summary Judgment on the basis that Plaintiff had no evidence to support a theory of liability against our client. The expert evidence was worked up by Joe Harrison and the Motion was prepared by Iris Harris. The Court granted our Motion.

Strawberry-Cabernet Barbecue Sauce

Ingredients

  • 1 Tbsp. canola oil
  • 1/2 medium onion, chopped
  • Kosher salt and freshly ground black pepper
  • 4 oz. strawberries, trimmed and quartered (about 3/4 cup)
  • 1/2 c. Cabernet Sauvignon
  • 1/3 c. apple cider vinegar
  • 1/4 c. sugar
  • 1/4 c. ketchup
  • 2 Tbsp. Worcestershire sauce
  • 1 Tbsp. pure maple syrup
  • 3 cloves garlic, chopped
  • 1/2 to 1 jalapeño, seeded and diced


Step 1

Heat oil in a medium saucepan over medium heat. Add onion and season with salt and pepper. Cook, stirring occasionally, until golden brown, 7 to 9 minutes. Stir in strawberries and Cabernet Sauvignon. Increase heat to medium-high, and cook until berries soften, 3 to 4 minutes. Add vinegar, sugar, ketchup, Worcestershire, maple syrup, garlic, and jalapeño. Bring to a boil. Reduce heat, and simmer until slightly thickened, 8 to 12 minutes. Let cool slightly. 

Step 2

Transfer mixture to a blender and puree until smooth (or use an immersion blender directly in the pan), about 30 seconds. Return to pan and simmer, if necessary, until sauce thickens, 1 to 2 minutes. Let cool, and use to baste grilled chicken, ribs, or pork chops.
