Do you need a will or trust?

Are you confused about whether you need a will or trust? Don't worry, many people are. 


Wills and trusts are very different estate planning documents. Either can be the right choice, depending on circumstances. While both provide instructions for distributing assets following death, a trust is generally a much more detailed document.


Let’s examine the difference: 


  • Simple will: A will only takes effect when you die. Also, a will generally will be processed through the probate court, so your family’s assets are available for public view. This may subject your family to unscrupulous creditors and heirs. Probate can also take time and be expensive.
  • Trust: A trust takes effect when it is signed and funded. As a result, it can protect you if you are incapacitated. A trust also is not open to the public and can reduce future legal costs significantly by avoiding the probate process. It protects and preserves your assets and can minimize taxes. A trust also allows you to decide when and how your assets will be distributed in a non-public forum. If you have children, a house, a blended family and other assets, you will likely need a trust. 


It’s always beneficial to begin your planning process as soon as possible. Working with an attorney can help you decide which estate planning documents are right for you and how this may change over time. Taking time to understand the process will help ensure your family and assets are properly protected.
