Take Steps to Ensure Paying Correct Sales Tax

In 2023, the Wisconsin Legislature authorized a sales tax for both the City of Milwaukee and an increased sales tax for Milwaukee County through Wisconsin Act 12. As a result of that legislation, starting January 1, 2024, the combined sales tax rate in the City of Milwaukee became 7.9% and only 5.9% for the rest of Milwaukee County. As we are now two weeks into the new year, there have been reports of businesses charging the incorrect sales tax. One of the main reasons for this incorrect sales tax charge is due to zip codes stretching over multiple municipal boundaries, which includes and defaults to Milwaukee. Brown Deer and several other Milwaukee County suburban municipalities have been notified of these inaccuracies, and because of those reports, contacted the Department of Revenue (DOR) to follow up with the reported businesses to resolve the issue. Brown Deer officials are also following up with legislators at both the state and federal levels to seek solutions addressing issues that stem from zip codes stretching over multiple municipal boundaries that default to Milwaukee.

Below are some general questions regarding the sales tax changes and tips when making a purchase.

What if I believe I am overcharged for sales tax?

If you believe you were overcharged sales tax by any retailer, you are entitled to seek a refund from that retailer. Save your receipt. You can ask for a refund in person at the store, or you can submit a written request for a refund to the retailer that over-collected sales tax. Wisconsin law states that retailers who over collect sales tax must return the tax collected in error to their customers or remit to the DOR. Upon a written request, the retailer must review and determine whether the tax was collected in error within 60 days of the request. Contact DOR to report any inaccurate sales tax collection at [email protected] or call 608-266-2776. DOR will follow up on all reports of inaccurate sales tax collection.

How do I know which sales tax applies?

To identify the correct sales tax that applies to your purchase, use the Department of Revenue look up tool. For in-store purchases, use the store address. For online purchases of merchandise, use the delivery address. If an address is missing from the lookup tool or you believe it is assigned to the incorrect municipality, please contact DOR at [email protected] or call 608-266-2776.

What if the sales tax overpayments exceed $50?

If you have sufficient copies of invoices showing the total overpaid in Wisconsin sales tax is $50 or more, you may request a refund directly from the DOR. Submit your refund claim using the department’s My Tax Account portal – select “Buyer’s Claim for Refund” to get started.

Need more help?

A new web page of City of Milwaukee Sales and Use Taxes Common Questions has been published on the department's website. You can access it from revenue.wi.gov under Current Topics. The web page provides links to the Wisconsin State and Local Sales Tax Rate Lookup for retailers to use to look up a street address or 9-digit zip code to determine if a sale takes place in the city of Milwaukee and is subject to the additional 2.0% city of Milwaukee sales and use tax. The web page also describes what retailers and consumers should do if the retailer charged 2% city of Milwaukee tax in error, or if the retailer incorrectly did not charge 2% city of Milwaukee tax on sales that occurs on or after January 1, 2024.

Village of Brown Deer Enrolls in Wisconsin Help for Homeowners Program

Wisconsin Help for Homeowners (WHH) is a new statewide program that can help with overdue bills like mortgage payments, property taxes, utilities, and more. The program is open to individuals and families who live in Wisconsin with overdue housing-related bills, both with and without a mortgage, who meet income and other eligibility requirements, and have experienced a qualified economic hardship since January 21, 2020.

Homeownership is an important tool to building wealth. As we help local families recover from the pandemic, the Social Development Commission (SDC) believes providing households with assistance is essential. You will find the eligibility requirements to receive help with housing costs and how you can apply on their website at https://www.cr-sdc.org/services/residential/wisconsin-help-for-homeowners.

What is Cross Street Plowing and

Why is it Illegal in Wisconsin?

Pushing snow onto or across roads from private driveways can cause accidents, death and /or municipal snowplow damage and is prohibited by Wisconsin Law Statutes 86.01, 86.07, 346.94. and/or 941.03

Additionally, Brown Deer Municipal Code Section 50-117 – Unlawful Removal states: It shall be unlawful for any person, firm or corporation to plow, shovel or otherwise deposit snow or ice, or cause snow or ice to be plowed, shoveled or otherwise deposited on any adjacent private property, public street, public sidewalk, public place or public property within the Village. Persons may deposit snow on the terrace or drainage ditch of the public right-of-way directly adjacent and bounding the private property the snow or ice was removed from.

Essentially the snow you remove from your driveway should remain on your property and not be pushed into or across the street.

If you hire a contractor to assist with snow removal, please inform them of the restrictions as code compliance is your responsibility.

Our North Shore Community

January is #radonaction month. About 1 in 10 homes in Wisconsin have high levels of radon, which can cause cancer.

Take action today by testing for radon. NSHD sells short-term radon test kits for $7.00. Please stop by or call our offices at 414-371-2980 to schedule a time to come and pick up a test kit.

The cost of mitigation can be a barrier for some families and businesses; Wisconsin residents can visit https://ow.ly/n7j050QnYtc to find their Radon Information Centers (RIC) in Wisconsin or speak with local public health department radon experts by calling 888 LOW-RADON to discuss available options. Reduced-cost test kits are available through RICs, and test kit promotions are happening throughout January.
