Department of Labor Proposes New Rule to Distinguish Independent Contractors from Employees

On October 13, 2022 the Department of Labor (DOL) published a notice of proposed rulemaking advising that it intends to alter the test used to distinguish “independent contractors” from employees under the Fair Labor Standards Act (FLSA).
- The proposed rule will rescind the 2021 Independent Contractor Rule and replace it with a multifactor, totality-of-the-circumstances test that will likely cause an increase in the number of workers classified as employees.

Quiet Quitting: It’s The Wake-Up Call Employers Need

Employees are putting employers on notice. By “quiet quitting” or flat-out resigning, the U.S. labor force is sending a clear message about its priorities and expectations. According to a Gallup survey, half of the country’s employees define themselves as “quiet quitters,” or people who get the job done without going above and beyond.
This trend comes in the wake of a tidal wave of actual resignations, with more than 47 million people leaving their jobs last year as part of the ongoing Great Resignation.

EEOC Issues Revised Version of New Rights Poster

One day after releasing a new required poster for covered employers, the U.S. Equal Employment Opportunity Commission (EEOC), on October 20, 2022, published an updated version that it is instructing employers to use instead. The EEOC had, on October 19, 2022, released a new poster entitled “Know Your Rights: Workplace Discrimination is Illegal,” which replaced the 13-year-old “Equal Employment Opportunity is the Law” poster and its 2018 supplement. The agency has released a revised version of the “Know Your Rights” poster without explanation.

Disengaged Workers? It’s Time to Fix Your Company Culture

Quiet quitting may be a relatively new phrase, but its inspiration has been around for decades. Take 1999’s Office Space, the famous depiction of mindless work at a company with no meaningful culture. In the movie, Ron Livingston’s character (“Peter Gibbons”) and Jennifer Aniston’s “Joanna” are performing individual acts of “quiet quitting.” Peter famously speaks honestly to the two consultants hiring him, saying, “I’d say, honestly, in a given week, I probably only do about 15 minutes of actual work.”

2023 FSA Limits Increase in Response to Rising Inflation

Spurred by soaring inflation, which has been on an upward trajectory over the last year, the Internal Revenue Service pushed the cap for flexible spending accounts next year above $3,000 in one of the larger increases in recent years. Employees will be able to contribute $3,050 to FSAs—made pretax through salary reductions—in 2023, the agency said this week. That’s up $200 from this year’s $2,850 limit. Researchers found that on days when employees thought their outfits were attractive, workers felt better about themselves and made more progress toward their goals. When Joseph Kim, assistant professor of management at West Chester University, was a doctorate student, his colleague, Ryan Vogel, said he let fashion fall by the wayside. Clothes are “not very important,” Vogel quipped, when you’re focusing on surviving a PhD program. But even if Kim didn’t notice whether his socks matched, Vogel did notice his wife’s fashion—and observed that she seemed happier when she dressed better. As the saying goes: happy wife, happy life—and in this case, it was also the spark for a new research project.

IRS INCREASES FSA 2023 CONTRIBUTION LIMITS

Flexible spending account (FSA) contributions for 2023 will rise to $3,050, an increase of $200 from the 2022 limit. The limit also applies to limited-purpose FSAs used to reimburse only dental and vision care services. If an employer plan permits carryover of unused health FSA funds, the carryover amount will increase to $610, an increase of $40.
