As the holiday season approaches, I often find myself reflecting on the important things in life, like my family, making memories, and the opportunities I have to impact others. While my Partner Perspective typically focuses on my family and friends, I want to take this time to reflect on the gratitude I have for my profession. Having recently celebrated my 11th year anniversary of being licensed to practice law in the State of Florida, I am choosing this holiday season to remember my Why.
Day-to-day, we get bogged down in the daily grind, the productivity reports, and the outstanding receivables. All these things make it easy to forget the Why. For me, it’s simple: my Why is helping those who cannot help themselves. It’s the reason I became a lawyer. I wanted to make an impact. It was a genuine desire to help others and leave others a little bit better.
Recently, I was reminded of my Why with the opportunity I had to help a husband and wife who entered a commercial transaction to sell a concession stand/food truck. The purchaser refused to pay for the concession stand despite continuing to operate and make money from the use of the concession stand. While replevying a concession stand may seem small or unimportant to some, it was extremely important to this family. Despite the intentional delays by the purchaser, together with my clients, we were able to force the case to trial and prevail. We obtained a writ of replevin, and the concession stand was returned to my clients, the rightful owners.
The gratitude that my clients expressed was overwhelming, and it was a reminder of the ability that we all possess to make an impact and change the lives of others.
As we approach the holiday season and the beginning of a new year, I challenge you to remember your Why. Ask yourself: are you accomplishing your Why? If not, as you plan for 2024, consider what you can do to achieve your Why and how it can empower you to help impact the lives of others.
I wish you personal and professional success and fulfillment this holiday season and as we head into the new year.

We expanded the team last month with the additions of Logan Thompson, Chief Financial Officer, and Justin Coderre, Director of Operations.
Logan is a Florida-licensed Certified Public Accountant (CPA) that has spent over 15 years building accounting and financial acumen. Justin brings with him 8 years in the legal services industry, 5 of which were spent in management roles within operations. We are very excited for the advances these two experts will bring to our firm.

While not all incidents of theft are prosecuted in the criminal system, Florida’s civil system has two causes of action that allow a person or entity to pursue the theft of either money or personal property. These two causes of action are Conversion and Civil Theft, and while they are similar in some regards, there are also stark differences that affect important aspects of a claim, such as the amount of damages available and a plaintiff’s burden of proof.

Judgment creditors are often faced with the question of how to collect an out-of-state judgment (also commonly referred to as a foreign judgment) in Florida. Generally, when a creditor obtains a judgment in another state, and the judgment debtor is located in the State of Florida, or assets the judgment creditor wants to obtain are located in Florida, the judgment creditor must “domesticate” the judgment in Florida.

Employers must ensure that they provide employees with leave benefits in compliance with all federal and state regulations. One such lesser-known Florida regulation, Section 741.313, Florida Statutes (the “Act”), mandates employees are provided with leave for certain purposes after encountering domestic violence events. In essence, the Act aims to give victims the opportunity to seek safety, medical care, legal assistance, or counseling without fear of losing their jobs.

November was a busy month at our firm, full of hard work, team bonding, and several fun events. These events provided us with ample opportunities to relax, unwind, and reflect on the things we are thankful for.
November was full of delicious midday treats as we celebrated National Nacho Day, National Vanilla Cupcake Day, and had a Thanksgiving Potluck lunch, where colleagues brought in their favorite Thanksgiving food items to share with the firm. At Jimerson Birr, we believe that our fun socials provide far more than just a break from work – they offer the opportunity for colleagues to collaborate and innovate in a relaxed environment, all while enjoying some delicious food.
Here at Jimerson Birr, we’re dedicated to nurturing our employees’ mental and physical well-being. We believe that a balanced mind is the cornerstone of both personal and professional success which is why we brought in a massage therapist to provide in-office table massages for our employees.
We continued our tradition of proudly supporting our Jacksonville Jaguars by wearing our best Jaguars gear the Friday prior to each home game. For those who aren't Jaguars enthusiasts, we extended a warm invitation to sport the colors and emblems of their favorite college teams, fostering a sense of unity and individual expression that defines our unique workplace culture.
