ACC STL Chapter Celebrates 2021 National Pro Bono Month
Members volunteer to provide free legal counsel to individuals and families
by partnering with local organizations
By: Ann Marie Mayuga
Partner, AMM Communications
October was National Pro Bono Month. This annual opportunity is a way to shine a national light on the pro bono work provided by thousands of lawyers, paralegals, and law students.
For ACCSTL, each year members give hundreds of hours of free legal counsel and guidance, and volunteer for community services projects through programs and events arranged by the Pro Bono Committee. Patricia Duft is the 2021 ACCSTL Pro Bono Chairperson, and Senior Legal Director, Medtronic.
“Each October, we are reminded of the impact that we can make as attorneys in our community. ACC STL members consistently step up and show up to provide much needed free legal counsel to underserved communities, families, and individuals. By giving back to the St. Louis legal community, we gain much more personally than we professionally give to the clients we serve by preserving access to legal services. This is the foundation of our legal framework,” said Duft.

ACC St. Louis members take a guided tour
of the Underground Railroad System
Association of Corporate Counsel - St. Louis members recently participated in a two-hour guided shuttle tour of the the Underground Railroad that commenced in Alton, Illinois. The historical tour was sponsored by the Great Rivers & Routes Tourism Bureau and led by Underground Railroad historian J.E. Robinson.
"My husband and I greatly enjoyed the Underground Railroad Tour," said ACCSTL member Nancy Bukovic. "It was very thoughtful and brought a new and more detailed perspective for me regarding slavery, the slave trade, and specific events in Missouri and Illinois that impacted the lives of slaves and free blacks in the Civil War era. It also provided a deeper understanding of the operations of the Underground Railroad in the local area."
Participants are taken by Robinson to sites scattered throughout Alton and Godfrey where escaped slaves took shelter while working their way to freedom over 150 years ago.
Bukovic also noted that the social time after the tour was wonderful with the small intimate group. "It was so nice to meet new people and have time to have real conversations, not merely social niceties," said Bukovic.

“Recent Developments in the Concept of Good Faith
Under Canadian Law”
A summary and analysis of the Supreme Court of Canada’s decisionsin
Bhasin v. Hrynew, C.M. Callow Inc. v. Zollinger, and Wastech Services Ltd. v. Greater Vancouver
Sewerage and Drainage
By: Todd J. Burke and Michael Walsh
Introduction:
In Canada, the concept of good faith in contractual dealings has recently been the subject of two decisions of the Supreme Court of Canada. These decisions broaden the concept of good faith as an organizing principle of contract law that was first recognized in Bhasin v. Hrynew, 2014 SCC 71 (Bhasin).
In 2020, the Supreme Court developed the concept of good faith in C.M. Callow Inc. v. Zollinger, 2020 SCC 45 (Callow), a case where the Court determined that a party cannot stay silent if another party acts on a misapprehension arising out of the first party’s deception or misrepresentation.[i]

Religious Accommodations
to COVID-19
Vaccination Mandates:
a Roadmap for Employers
Mandatory COVID-19 Vaccination and Religious Accommodations:
A Roadmap for Employers
By: Burton D. Garland and Sean J. Oliveira
I. Religious Accommodation – Something Old, Something New:
Mandatory vaccination policies are nothing new.[i] What is different in the COVID-19 context, are the deluge of requests for accommodation.[ii] Given that vast case law under the Americans with Disabilities Act (“ADA”) and that the medical conditions which present a potential adverse reaction to the COVID-19 vaccinations are relatively pre-defined,[iii] the requests causing the most difficulty for employers are those for religious accommodation. Naturally, determining their legitimacy is an issue.[i] What’s worse, religious leaders (and certain others who may be less scrupulous) have not been shy about announcing to people that they are willing to provide (sometimes for a fee) letters supporting these requests.[ii]

ACCSTL Committee Spotlight: Law School Relations
The Association of Corporate Council St. Louis' Law School Relations Committee cultivates relationships with local law schools and programming to introduce law students to in-house work, including the Externship Program with SLU and promoting in-house careers with Washington University. "This committee supports pivotal programs with local law schools to promote the in-house practice and ACC STL to lawyers-in-training," said Pam Howlett, Committee Chair, and VP & Associate General Counsel at Bayer.
SLU Externship Program
The Corporate Field Placement Program at SLU Law provides law students with unpaid externship opportunities in corporate legal departments in the St. Louis area. Students receive one credit hour for each 50 hours of work in the Field Placement. These experiential learning credits are a critical part of, and ABA requirement for, a student’s legal education. All students must have completed at least one-half of their law school education before undertaking a Field Placement.

Review of Recent ACCSTL Member Appreciation Event
By: Vikas M. Sunkari, Senior Legal Counsel
System Legal Affairs
On October 28, 2021, the ACC St. Louis Chapter’s Membership Committee hosted a membership appreciation event in the form of a virtual wine and food pairing. Tim Brennan and Kris Hoffman of Cravings Restaurant talked ACCSTL members through five varied courses with associated wine pairings, sharing stories about the development of the presented dishes, details about wine and how it can complement or go against a dish, as well as personal anecdotes about food and wine adventures. Tim and Kris fielded the questions of members and provided recommendations for local wine shops and how to best enjoy and serve wine – but notably, to honor the preference of the person drinking it!
