Final Determination on the Appeals of the Lookout Slough Tidal Habitat Restoration and Flood Improvement Project Certification of Consistency

On July 16, 2021, the Delta Stewardship Council voted to adopt a Determination including detailed findings regarding the Appeals of the Certification of Consistency for the Lookout Slough Tidal Habitat Restoration and Flood Improvement Project (C20215), pursuant to Water Code section 85225.25.
A resilient statewide water supply and ecosystem necessitate collective implementation of the Delta Plan. The Delta Plan creates a common vision for taking-on current and predicted challenges and includes regulations, non-regulatory recommendations, and performance measures to further water supply reliability, ecosystem resiliency, and the unique values of the Delta as a place.
The Delta Reform Act of 2009 established a certification process for demonstrating consistency with the Delta Plan. Before a state or local public agency implements certain projects in the Delta, they are required by California law to certify that the project is consistent with Delta Plan regulations. These projects are known as covered actions.

Anyone can appeal a project certification submitted to the Council. When this happens, the Council analyzes the certification against Delta Plan regulations to determine whether the evidence – in the certification – supports that the project is consistent with the Delta Plan based on issues raised in the appeal.
