Question:
I currently have a listing agreement with a seller who wants to cancel the agreement. They want to list with another agent. Can the seller cancel the listing agreement before the expiration of the agreement?
 
Answer:
Listings are personal service agreements that create agency relationships. A personal services contract cannot be specifically enforced. That means you cannot force a person to continue to receive services they don’t want. All agency relationships are by consent. If either party withdraws consent, the agency relationship ends. Refusal to receive service or withdrawal from an agency relationship can be done verbally or by email or writing or even by implication. These are matters of proof, not means. As soon as an agent understands that the principal will no longer allow the agent to represent them or provide services under the listing agreement, the relationship ends. What doesn’t end is the contract itself.  If a seller terminates a listing agreement without legal excuse, they breach the contract.  Breach of contract raises the issue of damages, but that doesn’t mean the seller can’t terminate the listing. It just means if they do, they may be liable for any damages caused. Most listing agreements have liquidated damages clauses in them to deal with unexcused early termination. If suing your seller for breach of contract is where you’re headed, make sure you consult with the company attorney before taking action.

This month we spotlight OAR member Tanner Helm from Fred Real Estate Group in Bend, Oregon. Six years ago he took a leap of faith and got into the business. " I think the most courageous thing I've done in my life was starting my real estate career. We had three kids under the age of four with no safety net, no back up plan. I put myself in a position where I was forced to be successful."

Since then Tanner has been learning all he can about the business. His advice to someone just starting out? "Keep it simple, learn how to go get business before you spend time learning all of the minutia. Wake up every morning and go get hired."

Tanner recently became involved with OAR by volunteering for the Strategic Planning Committee. "I haven't previously been involved, but I am very excited about opportunities to be a part of leadership teams in the future."

Tanner keeps busy spending time with his wife and three children, but also finds time to enjoy archery, bowhunting and is a huge Dodger's fan. His bucket list includes seeing all 162 Dodger's games in one season! Go Tanner!
