Senate Bill 608: STOP Statewide Rent Control!
Have you heard about Senate Bill 608? The Oregon Senate is about to take unprecedented action by passing a statewide rent control program. This has the potential to cause more harm than good for tenants. Rent control programs: 
  • Decrease mobility for tenants and require larger security deposits to recoup costs associated with damage.
  • Encourage the transition of rental units to condominiums as well as provide incentive to tear down existing buildings for the construction of new ones.
  • Discourages further investments in much needed housing.
A statewide rent control system is unprecedented and NO other State has adopted a statewide standard for rent control.

Professional Standards Academy
OAR is hosting a one day Professional Standards Academy to train your volunteers that serve on Grievance Committees, Professional Standards Committees and anyone on your Board that may participate in the ratification/appellate process. AEs and staff specialists are welcome to attend as well as any volunteers that may have an interest in serving on these committees.

First Time Home Buyers Savings Account
The Oregon Department of Revenue has released the rules and a flyer regarding the First-Time Home Buyer Savings Account program. The program will allow Oregonians to take a state tax deduction for saving money towards a down payment and other related costs associated with the purchase of their first home. The program applies to tax years beginning on or after January 1, 2019. We are currently working with banks and credit unions across the state and will update you as soon as we have further information.

We have a seller with 25% fractional ownership in a beach house currently listed. They are family members.
We have been contacted by one of the owners that we should not have been given a key and it can only be shown if the other owner is there. They are rarely there. The parties do NOT have an ownership agreement or anything in writing about use and rules.

Can they block us from showing the home since it's vacant? We have a key provided from one of the owners. They don't have a rule regarding showings. We advised our seller to get legal counsel, however he says he gives us permission to show it and he wants it shown when vacant. Can we show it?

A fractional owner of real property has a right of access to and use of the property unless otherwise agreed upon by and between the owners. Thus, it is appropriate for the seller to provide you with access in order to show the property, and you can proceed ahead with the listing. However, to the extent that your access to the property creates potential risk, you may wish to consider whether the risk is worth the listing.

The cost for a one year Legal Hotline subscription is $125 per individual subscription. The Legal Hotline is open Monday – Friday, 9:00 a.m. to 12:00 p.m. (except during NAR & OAR conventions and Holiday's). Subscribers may e-mail questions to the Legal Hotline at any time and can expect an answer within 24 hours (excluding weekends and holidays). Changes in license status or brokerage will not affect an individual's subscription or access to the Legal Hotline.
