Some REALTORS® and brokerages have recently received a letter from the Oregon Department of Revenue reminding them that Oregon’s new Corporate Activity Tax goes into effect January 1, 2020.

HB 2001 - Housing Choices
House Bill 2001 aims to provide Oregonians with more housing choices, especially housing choices more people can afford. The law, passed by the 2019 Oregon Legislature, lets people build certain traditional housing types, like duplexes, in residential zones. These housing types already exist in most cities, but were outlawed for decades in many neighborhoods. This bill will require updates to local laws that currently limit what sorts of housing people can build. These limitations contributed to increased housing costs and fewer choices.

HB 2003 - Housing Needs Analyses
House Bill 2003, which passed in 2019, requires the Oregon Land Conservation and Development Commission (LCDC) to establish a schedule (by December 31, 2019) for all Oregon cities with a population of more than 10,000 to adopt updated housing needs analyses (HNAs).

House Bill 2003 requires those cities within the Portland Metro UGB to update their HNAs every six years. Cities outside the Portland Metro area must update their HNAs every eight years.

Legal Hotline Q&A
Question: There is an agent licensed in another state that would like to buy one of our listings.  This agent has asked us to write the offer and is requesting we give them the selling side of the commission. I am concerned because we will have the liability from the buyers side, but not be getting paid for it. I told the agent I would be more comfortable giving a referral fee rather than the buyers side of the commission. Can an out-of-state licensee get the selling side of the commission even without representing themselves?

Answer: No broker who is not a member of your MLS can get anything unless you agree to it. There is no right to a commission based on having a real estate license.  There is no right to commission based on being the procuring cause unless there is a prior agreement to that affect. Most such agreements are through the MLS in the form of a unilateral offer of compensation to cooperating MLS members. If the person is not an MLS member, you have made them no offer. That means you are free to do whatever you want with this person and it is your decision alone what to do.  It doesn’t matter for commission purposes who represents who because compensation is based on procuring cause under an offer of compensation, not representation. Until and unless you create one, this person has no offer of compensation under which to claim a commission or referral or anything else.
