Oregon Passes Statewide Rent Control
Despite an outpouring of vocal opposition by our membership and a continual effort by our government affairs team, Senate Bill 608 has passed the Senate, the House and has been signed by the Governor. Due to the emergency clause in the bill, it is effective immediately.
 
Our legal staff has developed a  summary of the impacts of Senate Bill 608 along with some FAQ’s . In addition, our Education department has developed a live webinar to review the bill.

We would like to thank the 2,609 REALTOR® members who took the time to respond to our call for action in the Senate and the House. Our advocacy goals continue to focus on addressing the housing supply/demand curve and finding comprehensive ways to accelerate the development of homes for Oregonians of all income levels.

Property Management Forms
Based upon SB 608 passing in Oregon, all rent increase notices, termination notices, without stated cause, and non-renewals should not be used without consulting legal counsel. The Multifamily Northwest forms as related to these changes have not yet been updated and use of existing forms or a result of liability under the recent changes to the law governing properties in Oregon. Steve Strode
Real Estate Commissioner
2018 OAR Past President, Steve Strode, is officially the new Oregon Real Estate Commissioner. Steve has more than 18 years of expertise in the industry, including managing his own brokerage. He was first licensed in Wisconsin in 2001, then Oregon in 2008. The Real Estate Commissioner's role is to provide leadership and policy direction to the Oregon Real Estate Agency. The agency is responsible for licensing and regulation of real estate. Congratulations Steve!
Credit Union Participates in First Time Home Buyer Savings Account Program
Consolidated Community Credit Union of Portland is offering the new First Time Home Buyer Savings Account Program to its members. You can learn more about their program and some special incentives by clicking here.

The Oregon Bankers Association has sent out a white paper and bulletin to their members encouraging more banks and credit unions to develop the account option. OAR will list all participating banks and credit unions on our website.

Spring Governance
This year's Spring Governance will be held April 10-12 at the Salem Convention Center. The agenda is full of exciting, beneficial events that you won't want to miss. Most events are free of charge. There will be committee meetings, an informative finance meeting, the ever-popular Principal Broker Forum, OAR's REALTOR® of the Year award luncheon, RPAC events and our bi-annual Board of Directors meeting. As an added bonus, we will be offering continuing education in the form of our At Home with Diversity® class. Check out the agenda for a detailed schedule and descriptions.

RPAC National Competition
On Monday, March 4, 2019 we are kicking off the 2019 RPAC state competition and we need your help. Through the month of March, OAR will be competing against other participating state associations to see who can recruit the most investors and raise the most funds during the REALTORS® Political Action Committee (RPAC) March online campaign. 

The four states with the most investors and dollars raised will be announced on April 2 and will receive a special certificate and bragging rights. More information coming soon. Click on link to learn more about RPAC.

LEGAL HOTLINE Q&A
Question: If a buyer and seller are fighting over return of the earnest money (earnest money is at escrow company), can our broker return it back to the buyer and have the escrow company give the deposited earnest money directly to the seller?

Answer: It appears that you are asking whether a broker can pay money out of pocket to the buyer in order to settle a potential dispute over the earnest money. In such a situation, the broker’s payment to the buyer would constitute a settlement rather than an unlawful sharing of commissions. We recommend that as a condition of paying such amount, the broker require the buyer to execute an agreement in which the broker is released from liability relating to the payment of the earnest money. That way, the broker can attempt to avoid any future problems with the buyer relating to this matter. It would be a good idea to recommend to the buyer, in writing, that they seek legal counsel prior to executing such a release. The broker should also suggest that the broker consult with their attorney in order to determine how best to structure a settlement.
