The election is less than one week away and voting polls show a very close race for many candidates and issues. WE NEED YOUR HELP! The Oregon Association of REALTORS® has worked very hard to put Measure 104 on the ballot. Many of you have supported our efforts to get the word out and now we need your help with one last push for YES ON 104!

This measure is important because it ensures that any legislation that raises revenue by taxing homeowners requires a three-fifths majority vote. This includes fees or the elimination of tax exemptions, deductions or credits. You can visit the YES ON 104 website for more information. We encourage you to share your support on social media and at the voting polls.

Time is running out to make your voice heard. Please don’t forget to return your ballot and vote YES ON 104! Together we can protect important tax deductions for Oregon families and small businesses!

Question: The seller of a home received an offer from a potential buyer and opted to reject the offer and propose a counter offer. Shortly after the seller (offeror) sent the counter offer, the seller wanted to rescind their counter offer and not move forward with the potential buyer. Seller immediately sent a notice of rescission to the potential buyer (offeree) prior to receiving an acceptance of their counter offer from the buyer. Did the seller adequately rescind their counter offer? 


Answer: Likely, yes. An acceptance of an offer (or counter offer) is effective when signed and the offeree sends it. This means that it’s not when the offeror actually receives the acceptance, but instead when it’s been signed and sent on its way. This can of course create confusion and debate as to when the acceptance was technically sent and whether the rescission was sent prior to the acceptance. While timing had the potential to be hotly debated in the past, due to the widespread use of DocuSign and e-mail to communicate, documents are generally sent and received instantaneously and their digital timestamps leave less to be debated and more certainty for buyers and sellers in todays market. The key here is simply whether the seller in this instance rescinded their offer prior to the buyer accepting their counteroffer. Because the seller here sent their rescission before the buyer signed and sent their acceptance, it would appear the rescission was successful. For further clarification on this issue, we would direct you to the definitions section of the OREF Purchase and Sale Agreement, which includes a useful definition for purposes of real estate transactions.
