Session Report

Legal Hotline Q&A
Question: I have a manufactured home listing that is a complete teardown. It is being sold “as-is.” The buyers agent is asking for a Lead-Based Paint Disclosure. Do I need to provide the LBP Disclosure for a home that is not habitable when we are only selling the land?

Answer: “Teardown” and “as-is” don’t really help you when it comes to lead-based paint. The federal regulation applies to the sale of “target housing.” With limited exceptions not applicable here, target housing is anything people live in that was built before 1978. If the manufactured home was built before that date, it is target housing if you are selling the manufactured home as part of the sale. Because the home is attached to the land, you are selling it when you sell the property unless you say specifically otherwise. “As-is” and “teardown” don’t do that because the manufactured home is still on the property. Title will transfer and someone could legally live in the manufactured home. If you already have a deal, the easiest thing is to give them a Lead-Based Paint Disclosure with a cover letter that says the home was not intended to be lived in, that the seller makes no representation or warranties whatever as to its condition or use and that it is included in the sale for no value. If you don’t have a deal, you can do the same thing, or counter that the manufactured home is not included in the sale, not intended as housing, is of no value and that buyer agrees not to occupy the home or allow others to occupy it. In the end, it may be easier to just give the Lead-Based Paint Disclosure and beef up your disclaimers about the manufactured home.

The Legal Hotline is open Monday – Friday, 9:00 a.m. to 12:00 p.m. (except on holidays and during NAR and OAR conventions). Subscribers may e-mail questions to the Legal Hotline at any time and can expect an answer within 24 hours (excluding weekends and holidays). Changing brokerages or type of license will not affect an individual’s subscription or access to the Legal Hotline.

Principal Broker Academy
Last week was the first session of the new Principal Broker Academy. We had a full turnout and Brokers are very excited about the new program.

The PBA was added this year to provide new and seasoned Principal Brokers the opportunity for professional development. The next sessions begin in January in Medford, followed by Salem and Bend. There is limited space available!
