Update on Class Action Anti-Trust Litigation
REALTORS® are encouraged to have transparent conversations with current and prospective clients about the services they will provide and how they will get paid for those services. The National Association of REALTORS® developed the following message points to make sure members are up to date and knowledgeable about the litigation and help guide their conversations with current and prospective clients.

Question: If a seller receives a full price offer for their home, are there any potential consequences if they don’t accept the offer?

Answer: There is nothing that requires a seller to sell their property just because someone makes a “full price offer.” First, there is almost no such thing because offers, even full price offers, are usually full of contingencies. Some, like financing, can be more important than price in assessing viability of an offer. There are two potential consequences when a seller turns down a full price offer.  How serious they become depends mostly on why the seller is turning down the offer. The first is that turning down a full price offer can be evidence of discrimination. If the buyer is in a protected class, the seller better have a legitimate business reason for not taking the offer. I changed my mind and I’m not going to sell to anyone is a good reason (if it isn’t pretext) and so is the lack of financial ability of the buyer or some other acceptable reason. There also has to be a reason to head off a potential squabble over commissions. Arguably, the listing broker has earned a commission if a “full price offer” is produced. That being the case, the buyers agent may have a claim to the co-op commission if the listing broker actually collects a commission. If the listing broker doesn’t demand a commission, the reasonableness of that decision may be called into question. Of course, the reasonableness of the listing brokers decision will turn on the reasonableness of the seller’s decision not to accept the full price offer. So, what is the seller’s reason?
HUD to Announce Long-Awaited FHA Condo Rules
The U.S. Department of Housing and Urban Development is expected to release updated guidance on FHA-insured condominium financing. The new rules should benefit your real estate clients and customers by allowing more buyers to obtain low down-payment mortgages on affordable housing options.

Qualified Opportunity Zone Program
NAR is working with federal agencies, Congress, and community development groups to ensure that the Qualified Opportunity Zone (QOZ) program brings business opportunities for REALTORS®, as well as opportunities for them to be involved in the planning of new developments and businesses within zones.

Three More Banks Offer First-Time Home Buyer Savings Accounts 
The number of banks and credit unions offering the First-Time Home Buyer Savings Account program is growing! Just this week the Oregon Bankers Association has identified three new organizations offering the program, which brings the total up to five. 

Two OAR Members selected for NAR Leadership Academy
The National Association of REALTORS ® announced the roster of its 2020 NAR Leadership Academy class and two members are from Oregon; Drew Coleman from Lake Oswego and Adam Schwend from Tillamook County.

"This is a rigorous selection process, so congratulations are definitely in order," says OAR CEO Jenny Pakula.

Eighteen REALTORS ®  from across the country were chosen to participate in the10-month program designed to prepare emerging state and local volunteers for future leadership roles at NAR.
