Updates on Previously Introduced Legislation
House Bill No. 126 (PASSED)

Summary - Amends and adds to existing law to establish provisions regarding industrial hemp.

Status Update - H0126 passed the House (AYES 44, NAYS 26, ABSENT 0) on March 8, and passed the Senate (AYES 30, NAYS 5, ABSENT 0) on April 7. It was signed by the Speaker on April 8, signed by the President on April 9, and transmitted to the Governor on April 12.

House Bill No. 315 (PASSED)

Summary - Creates a state-directed fund for money the state receives from settlements or judgments from opioid litigation. The money in the fund will be used to support opioid prevention and recovery efforts.

Status - H0168 passed the House (AYES 67, NAYS 0, ABSENT 0) on March 15, and passed the Senate (AYES 35, NAYS 0, ABSENT 0) on April 13. It was signed by the House Speaker on April 14 and transmitted back to the Senate for the President's signature.

House Concurrent Resolution No. 11 (ADOPTED)

Summary - States findings of the Legislature and recognizes 988 as the universal mental health and suicide prevention crisis phone number.

Status Update - HCR011 was adopted by the House on March 8 and adopted by the Senate on April 7. It was signed by the House Speaker on April 8 and signed by the Senate President on April 9. It was delivered to the Secretary of State on April 12.

House Joint Resolution No. 4 (FAILED)

Summary - States findings of the Legislature and proposes an amendment to the Idaho Constitution requiring a 2/3 vote of the Legislature to legalize certain controlled substances.

Status Update - HJR004 failed in the House (AYES 42, NAYS 28, ABSENT 0) on April 15.

Senate Bill No. 1087 (FAILED)

Summary - Amends existing law to raise the age of legal possession and use of tobacco products and electronic smoking devices to 21.

Status Update - S1087 failed in the House (AYES 28, NAYS 40, ABSENT 2) on April 6.

Senate Bill No. 1110 (PASSED)

Summary - Amends existing law to revise signature requirements for ballot initiatives or referendum petitions.

Status Update - S1110 passed the Senate (AYES 26, NAYS 9, ABSENT 0) on March 1 and passed the House (AYES 51, NAYS 18, ABSENT 1) on April 7. It was signed by the Speaker and President on April 9 and delivered to the Governor on April 12.

Senate Bill No. 1150

Summary - Amends existing law to revise provisions regarding requirements for ballot initiative signatures to take place in Idaho.

Status Update - S1150 was reported out of the House State Affairs Committee with a Do Pass Recommendation on April 14.

Senate Bill No. 1165 (PASSED)

Summary - Relates to the appropriation to the Department of Health and Welfare for the fiscal year 2022.

Status Update - S1165 passed the House (AYES 29, NAYS 5, ABSENT 1) on March 10, and passed the Senate (AYES 42, NAYS 27, ABSENT 1) on April 6. It was signed by the Speaker and President on April 7 and delivered to the Governor on April 9.

Senate Bill No. 1189 (PASSED)

Summary - Relates to the appropriation of the Office of Drug Policy for fiscal year 2022.

Status Update - S1189 passed the Senate (AYES 32, NAYS 2, ABSENT 1) on March 19 and passed the House (AYES 69, NAYS 0, ABSENT 1) on April 8. It was signed by the Speaker and President and delivered to the Governor on April 12.

Legislation with No Change in Status

House Bill No. 31
  • Topic -This legislation would allow Idaho State Police (ISP) to perform testing for coroners that do not have the resources or do not want to pay for the testing at a private lab, permit ISP to share the results of the toxicology testing with the Department of Health & Welfare for statistical and monitoring purposes, and specify in state law that ISP Forensics can perform toxicology testing for these purposes.
  • Status - Introduced January 11 and referred to the House Judiciary, Rules & Administration Committee on January 25.

  • Topic - Amends and adds to existing law to authorize the possession, distribution, transportation, and use of cannabis for medical purposes.
  • Status - Introduced on February 9 and referred to the House Health and Welfare Committee on February 10.
