OSHA Employer COVID-19 Vaccination and
Testing Mandate Again on Hold

Today the U.S. Supreme Court issued a stay on the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Emergency Temporary Standard (ETS) that mandates larger employers to require their employees to be vaccinated for COVID-19 or be tested weekly and wear face coverings. The Court’s action follows arguments last week and comes after a lower court lifted an injunction against the ETS in late December.

The stay against the ETS is effective immediately and will remain in effect until the Sixth Circuit Court of Appeals finalizes their work on the appeal. If that decision leads to an additional review by the Supreme Court, the stay will remain in effect until the Supreme Court issues a judgement on the appeal.
