OSHA Issues Emergency Temporary Standard
for COVID-19 Vaccination and Testing
As directed by President Joe Biden, the federal Occupational Safety and Health Administration (OSHA) has issued a new Emergency Temporary Standard (ETS) mandating that employers require their employees to be vaccinated for COVID-19 or be tested weekly and wear face coverings.
The ETS applies to private sector employers (excluding those federal contractors or federal subcontractors who have to follow a more stringent standard) with 100 and more employees and those employers will need to adopt a policy by 12/5/21 and begin enforcing a testing requirement by 1/5/22.

Most employers in Michigan are covered by the Michigan Occupational Safety and Health Administration (MIOSHA) and, as an OSHA-approved state plan, MIOSHA would be required to implement the final federal rule expediently — as soon as 30 days and will most likely maintain the aforementioned federal implementation dates.
Legal action is expected and may impact the implementation of the federal employer vaccine mandate so stay tuned for developments on the situation.
