OSHA'S General Industry Silica Standard Goes Into Effect June 23
OSHA's General Industry Silica Standard goes into full effect in all industries except fracking on June 23, 2018. The standard establishes a new 8-hour time-weighted average permissible exposure limit, action level, and associated ancillary requirements. Despite decisively losing the court challenge on the standard, industry groups have been asking that OSHA delay enforcement of the rule until the end of the year. On industry's behalf a number of Republican Senators have written to OSHA asking for such a delay.
On Friday June 8, 2018, OSHA issued a press release and memo to the field on their plans for enforcement of the general industry standard. The June 23, 2018 effective/compliance date will remain, but for 30 days OSHA will not issue citations if employers are demonstrating a good faith effort to comply with the standard.
