Full Steam Ahead - EEOC Presses Enforcement of Pregnant Workers Fairness Act



The EEOC announced that it filed no fewer than six (6) lawsuits in September alleging employers engaged in pregnancy discrimination and/or failure to provide reasonable accommodation. Of those six, at least four alleged violations of the Pregnant Workers Fairness Act.

Speaking of pregnancy, one employer landed in hot water when it perceived a pregnant employee to be disabled and unable to perform her job. As a result, the employer got hit with a disability discrimination lawsuit. How's that work?

The ADA & FMLA: Intersectionality & Overlap


An employer maintained a policy that treated any employee unable to return to work following the expiration of FMLA leave as a “voluntary resignation” resulting in termination. The EEOC contends the employer violated the ADA when it simply followed its own policy and declined two employees' requests for extended leave.

U.S. DOL Announces New AI & Inclusive Hiring Tool


A new tool will support the inclusive use of AI in hiring technology and increase benefits to disabled job seekers. The AI & Inclusive Hiring Framework aims to help employers reduce the risks of creating unintentional forms of discrimination and barriers to accessibility as they implement AI hiring technology.
