Early Voting
Early voting is now the law in Connecticut. Voters registered in New Canaan can vote starting on Monday, Oct. 21st through Sunday, Nov. 3rd between 10am and 6pm at New Canaan Town Hall - 1st floor, across from the Registrar's office.
Election Day
Voting on Election Day will take place, Tuesday, Nov. 5th between 6am and 8pm. Voting on Election Day is done by district. District 1 votes at New Canaan High School, Districts 2 and 3 vote at Saxe Middle School and Districts 4, 5 and 6 vote at East School. If you are unsure of your district, contact the New Canaan Registrars of Voters office at 203-594-3060. If you will need a ride to the polls, either for early voting or on Election Day, please call Staying Put at 203-966-7762.

Absentee Ballots
Registered voters in CT can vote absentee if they are out of town on Election Day or if sickness or disability prevents them from voting in person. If this applies to you, absentee ballots will be available at the Town Clerk's office on Oct. 4th. If you can't make it to the Clerks' office, call Staying Put for an absentee ballot application. What is an Elder Law Attorney and Why You May Need One?

Elder law attorneys tend to work with clients over the age of 65, clients with disabilities, and clients with disabled loved ones. Many elder law attorneys have knowledge and experience with programs such as Social Security, Medicare and Medicaid. As an elder law attorney, I spend a lot of time with clients discussing advanced planning and the various legal documents that will support them as they age. These documents include Power of Attorney, Health Care Instructions, wills and trusts. All of these documents appoint an agent to “speak” for you when you are unable. I discuss the choice of agents for each of these jobs. For those who lack the capacity to execute these documents, we turn to the conservatorship process in the probate court to protect those individuals. Many of my clients are concerned about aging in place. As an elder law attorney, I have a working knowledge of many of the different housing options that are available to the senior/disabled population, such as independent and assisted living, continuing care retirement communities, residential care communities and nursing homes. Most people, however, would prefer to remain at home. For those clients, we discuss financial options to pay for care in the home, including Veteran’s benefits, reverse mortgages, and Medicaid.
Planning and applying for Medicaid is also a very specific area that elder law attorneys have experience with. I help families navigate the maze of paying for long-term care. The average cost of a nursing home in Fairfield County is currently $18,000 per month. A live-in homecare aide costs about $10,000
per month. Strategic planning is important to protect assets for the spouse and family, but sometimes, asset protection strategies may also be available in crisis situations.
As an elder law attorney, I also help families through the probate process when a loved one passes. The process can be very complicated and lengthy, especially without legal representation. Estate administration requires a team effort between the family and the attorney.
FAQ:
1. What the difference between a revocable trust and an irrevocable trust? Revocable trusts are used to minimize probate court involvement, and to manage more complicated beneficiary designations. Irrevocable trusts can be used to protect assets as a Medicaid planning strategy or for estate tax minimization. Revocable trusts can be amended, changed or revoked at any time before death. Irrevocable trusts, except in limited circumstances,
cannot be changed or amended once established.
2. Will Medicaid take my house if my spouse is in a nursing home? No. The home is an exempt asset if you are living there.
3. Do I need a power of attorney if all my accounts are joint? Yes. The power of attorney will be needed to access retirement accounts (IRA, 401(k)), to get information from insurance companies, and to transfer assets (if necessary).
4. Can I gift more than the annual exclusion of $18,000/person/year? Yes, you can gift up to your exemption amount (which is currently over $13m!); but you will need to file a gift tax return (no tax due). But if Medicaid is needed within five years of the gift, gifts of almost any value can be
problematic.
