Heaven’s 27 Camp Safety Act: What It Means for LPG in Campgrounds

Following the devastating July 4th floods, the Texas Legislature passed Heaven’s 27 Camp Safety Act during the second special session as part of a broader effort to improve youth camp and campground safety standards from camp emergency preparedness to camp alerts. The new lengthy bill now law, it references liquefied petroleum gas (LPG) storage and dispensing in campgrounds, raising questions for propane marketers.


Members should not be overly concerned. The Railroad Commission of Texas (RRC) still maintains exclusive regulatory authority over LPG under Chapter 113 of the Texas Natural Resources Code. The Commission’s preemption clause in Sec. 113.054 remains intact, meaning local governments cannot independently impose LPG ordinances without petitioning the RRC for approval and demonstrating a public safety need.


In short, while the Act outlines baseline NFPA campground standards, it does not transfer LPG authority away from the RRC. Propane regulation in Texas remains firmly under state oversight, and TPGA will continue to monitor and advise members on any local attempts to expand jurisdiction through the established petition process.

Texas Duty to Warn Safety 
Mailing Program Underway

The heating season is right around the corner. What perfect time to remind your customers about heating season precautions by participating in our Texas Duty to Warn Program where we mail safety information to each one of your propane customers.


How does it work?

1.   Texas propane retailers complete the online registration form & upload your Texas propane customer mailing list to the form.

2. The registration package is automatically sent to a third-party mail house.

3. You will receive an email confirmation as soon as your registration is received.

4. Your company name is ink-jetted onto the Texas safety mailer.

5.  The safety mailer is sent to your Texas customers within 30 days by non-profit bulk mail.

6.  Once mailed and payment is received, you will receive a postage receipt and a notarized affidavit from the mail house that your mailing is complete.


What does it cost?

The biggest savings for you is that there is no cost for the brochure when mailed in Texas. ProCOT covers the big price, the postage, to Texas customers.

Same fees as last year. Each Texas retailer participant is responsible for two pass-through fees. You, the retailer, are only responsible for a small $38 fulfillment flat fee and a 9.5-cent list processing fee per address.

Important mailing list tips

Deadline. Act now, because time is running out. The deadline to have your mailing go out in 2025 is December 4, 2025. The program is first-come, first-served while stock is available during the 2025-2026 heating season.
