The below article provides the latest on AB5 now signed into law in California. AB5 establishes a new statutory test for employees. It is known as the "ABC Test" and is a result of the California Supreme Court ruling in the Dynamex case.

In addition, NTA will be holding a free webinar on this subject in early November featuring Miles L Kavaller. Mr Kavaller is a regular contributor and writes MLK’s Transportation Law Tips on the NTA website under NTA NEWS. Also, remember that the Drug and Alcohol Clearinghouse takes affect in January 2020 and the Electronic Logging Device Mandate takes affect on Dec. 16, 2019. Follow our emails and will will direct you to all the latest on these industry requirements.

Drug and Alcohol Clearinghouse
In January 2020, the long-awaited Drug & Alcohol Clearinghouse goes live. This database of positive test results among commercial truck and bus drivers will undoubtedly catch those drivers who have evaded the system. This should improve safety in the motor carrier industry by making it easier to identify drivers who aren’t qualified to operate a commercial motor vehicle.

It will, however, come at a cost to carriers, both financial and in terms of new administrative burdens. Motor carriers should act now to prepare for the clearinghouse.
