It is hard to believe that it has been over a year since our last in person event. Although we miss seeing our fellow members in person, we are still so impressed with how well we have all been able to adapt to a virtual world, not just for work purposes, but for many aspects of our social life. I am sure everyone is seeing the light at the end of the tunnel, as the vaccine rollout continues to unfold. We still intend to continue using an online platform for the foreseeable future, until a time when meeting again is more attainable. We also see a lot of our member companies extending work from home until the fall and beyond, so will to continue in line with our members. On that note, this edition of the newsletter also includes an article from Barran Liebman to help employers navigate vaccinations, which is top of mind for all of us.
I would also like to take this opportunity to welcome our newest sponsor, Perkins Coie. We are excited to have them on board and leverage their expertise and nation-wide group of lawyers. They are hosting their first event on April 1st, about the engagement of employers in political and social movements. Last year brought to the forefront the importance of continuing to push the boundaries of diversity and inclusion efforts and made us recognize as a nation we have a lot of work ahead of us. As more and more companies join in this effort, this CLE will give you some insight to legal issues on this topic.
A top priority for me this year as president is to find ways that our organization can be more proactive in our community involvement and help develop programs that serve to increase our diversity and inclusion efforts. I hope to leverage our in-house community to provide more opportunities for those from diverse backgrounds. And I am happy to be writing this letter on National Women’s Day. May we all continue to pitch in to make space for everyone’s skills and capabilities.
Finally, we have shared a couple of pictures from our recent board meeting last month, where we had a chance to celebrate Mardi Gras virtually together. I want to continue to thank the board for their hard work and input as we continue our meetings virtually. I would also like to thank our sponsors for their continued creativity in developing engaging and informative programming. Working with them makes this role a lot of fun. We would also love to hear from our members about any topics or events that resonate with you, because that is what matters to us.

Should Employers Require COVID-19 Vaccinations? Considerations & Best Practices for Employers

Many employers are deciding whether they can—or should—require employees to receive a COVID- 19 vaccine. Here’s what we know so far:
Employers Can Legally Require Vaccination, With Some Exceptions.
The general rule, with some exceptions, is, yes, employers can require employees to be vaccinated. There are three main exceptions to the general rule: disability accommodations, religious accommodations, and healthcare workers in Oregon. Current guidance from both the U.S. Equal Employment Opportunity Commission (“EEOC”) and the Oregon Bureau of Labor & Industries (“BOLI”) confirm this position. See our previous E-Alert on the EEOC’s guidance for more details.
Here are the exceptions:
- Disability Accommodations: Employers must provide reasonable accommodations for employees who object to being vaccinated due to a disability, unless it would impose undue hardship.
- Religious Accommodations: Employers must provide reasonable accommodations for employees who object to being vaccinated due to sincerely held religious beliefs, unless it would impose undue hardship.
- Healthcare Workers in Oregon (ORS 433.416): Oregon law provides that healthcare workers may not be required to receive immunization as a condition of work unless the immunization is otherwise required by federal or state law, rule or regulation. See our previous E-Alert on this Oregon statute for more information, including who is a healthcare worker under this statute.

Barran Liebman Hosts Fifth
Annual New Year's Celebration
|
On January 20, Barran Liebman LLP helped Oregon ACC celebrate the New Year for the fifth year in a row.
This year's event was a little different as the firm hosted several teams of Chapter members and Barran attorneys in virtual escape rooms modeled on a classic Sherlock Holmes story. Teams had 60 minutes to explore Moriarty's Parlor virtually and work together online to solve puzzles to help them "escape" before the parlor "filled" with deadly gas.
The winning team, Morgan Woolley of Intel and InderBir Datta ofProKarma, along with Josh Goldberg and Amy Angel of Barran Liebman escaped in 49 minutes! For their efforts, Morgan and InderBir received e-gift cards of their choice of a variety of stores from the firm.
