KEY THINGS TO REMEMBER AS THE LITIGATION PROGRESSES

While today's order issued by the Federal District Court is a very significant and positive step, it is not final. It simply prevents the State from enforcing some of the most egregious provisions of Senate Bill 1 and a provsion already in statute prior to the signing of Senate Bill 1.

This is far from over, the acutal case has yet to be heard and the outcome is far from certain. What we can be sure of is this:

  • Either way the court rules, the losing side is certain to file an appeal in the Federal 4th Circuit Court of Appeals in Richmond.
  • Either way the 4th Circuit rules, the losing side will likely ask for an "en banc" ruling (as happened when we filed a lawsuit againt O'Malley's FSA 2013) by the 4th Circuit.
  • Either way a possible "en banc" ruling goes, the possibility (though somewhat diminished due to the Bruen decision) of an appeal to the Supreme Court exists.

"IT IS FURTHER ORDERED that the Motions for Preliminary Injunction are GRANTED as to the claims to enjoin enforcement of Maryland’s laws restricting the carrying of firearms in:"

ONLY the following provisions of Senate Bill 1 are enjoined by this order:

(1) locations selling alcohol, to be codified as Md. Code Ann., (2023), Crim. Law § 4-111(a)

(2)(8)(i) (See page 35 of 2A Maryland's 2023 Edition of Maryland Gun Laws)

(2) Private buildings or property without the owner’s consent, to be codified at Md. Code Ann., (2023), Crim. Law § 6-411); (See pages 80-81 of 2A Maryland's 2023 Edition of Maryland Gun Laws)

(3) Within 1,000 feet of a public demonstration, Md. Code Ann., (2016), Crim. Law § 4-208. (See page 53 of 2A Maryland's 2023 Edition of Maryland Gun Laws)

NOTE: This probitition pre-dates the passage of Senate Bill 1.
