Orlando, Florida - January 25, 2024 - The Health Law Firm announced that its President and Managing Partner, George F. Indest III, recently won favorable decisions and dismissals of three board of nursing licensing complaints being investigated in Maine, North Dakota, and New Mexico.
In one case, a hospital employee in Maine accused a traveling nurse working in a hospital of unprofessional conduct. The complaint alleged that the nurse risked patient safety because she left her shift without a proper patient handoff. Mr. Indest provided evidence during the investigation that the nurse did not have any patients to hand off at the time of the alleged incident. The Maine Board of Nursing voted to take no disciplinary action against the nurse and dismissed the case.
In the second case, the director of nursing at an assisted living facility in North Dakota accused a nurse, of making ten separate medication errors and discrepancies on one day, her last day of employment. Mr. Indest successfully defended the nurse against these accusations and obtained a dismissal North Dakota nursing board.
The third case involved a nurse working in a hospital in New Mexico. Another employee accused the nurse of patient abuse. Mr. Indest introduced evidence refuting the charges during the course of the investigation by the New Mexico Board of Nursing. The board of nursing voted to take no disciplinary action against Mr. Indest's client and closed the case.
"Each of these cases involved a traveling nurse. Traveling are temporary employees who often receive unfair blame by the regular nurses in a hospital or nursing facility. In each case, we spend a great deal of time and effort putting together a comprehensive presentation for the board of nursing to try to obtain a dismissal at the earliest possible stage of the process. If the case is dismissed early enough, usually there will be no mark of any kind against the nurse's license," Indest said.
Indest stated, "If you are a health care provider and you receive notice that any state or federal agency is opening an investigation on you, you should consult with an experienced healthcare attorney immediately. The consequences are too serious and early legal representation can mean all the difference in the world. Contact The Health Law Firm before you talk to an investigator."
