The Department of Health received a complaint that our client allegedly struck an infant patient. Mr. Smith successfully obtained a finding of no probable cause and dismissal of charges from the Probable Cause Panel of the Board of Nursing.

Mr. Smith stated: "The Department of Health originally asked our client to voluntarily relinquish (give up) her license. Based on our prior experience, we knew our client should not have to relinquish her license. Instead, we defended her and demanded that the Department of Health produce any evidence it had. As a result of our representation, we were successful in getting the case dismissed." Mr. Smith, as well as being a lawyer and a former hospital-based registered respiratory therapist, is also Board Certified in the Legal Specialty of Health Law by The Florida Bar.
