ICE announces another extension to review Form I-9
documents remotely, extending the deadline to August 19
IRS TO BEGIN ISSUING ACA PENALTY LETTERS AFTER JULY 15, 2020
Employers should start gearing up for IRS penalty letters issued under the Affordable Care Act. According to an announcement posted on the IRS website, the IRS has “has postponed mailing and responding to Employer Shared Responsibility Payment (ESRP) related correspondence until after July 15, 2020.” This decision to postpone ESRP correspondence was made based on the COVID-19 considerations.

Department of Labor Issues
New FMLA Forms
In a break from COVID-19 issues, the U.S. Department of Labor (DOL) on July 17, 2020, issued new model notices and forms for employers use when administering employee leave under the Family Medical Leave Act (FMLA).

These forms are optional and are not specifically required by the FMLA. (Employers and employees may use any format that provides the necessary information under FMLA.)

The DOL revised the forms to make them easier for employers, employees, leave administrators and healthcare providers to understand and convey and collect information necessary for an employee’s leave under the FMLA. They may be worth a look.

Treasury, IRS issue guidance on reporting qualified sick and family leave wages paid
The Treasury Department and the Internal Revenue Service today provided guidance in Notice 2020-54 (PDF) to employers requiring them to report the amount of qualified sick and family leave wages paid to employees under the Families First Coronavirus Response Act (FFCRA) on Form W-2.
