Determining Whether a COVID-19 Case is Work Related
The coronavirus (COVID-19) pandemic has created massive change and concern for employers and employees across the world. Even as businesses reopen and employees return to their new normal, the risk of becoming exposed to and ill with COVID-19 is still present. When an employee reports they have COVID-19, employers are faced with the difficult task of determining whether the employee’s illness is work-related.

PPP Updates
  • The House approved a bill that extended the application deadline from June 30 to August 8, 2020
  • The percentage of the loan that must be utilized for payroll costs (to receive full forgiveness) was reduced from 75% to 60%
  • Stronger safe harbor for employers that tried to bring employees back despite not being able to operate at the same level of business prior to February 15, 2020
  • Increase from 2 to 5 years of maturity of loans approved by SBA on or after June 5, 2020
  • Extension of deadline to defer repayments-must apply for loan forgiveness within 10 months of the end of your loan forgiveness period
  • Businesses with PPP loans can continue to defer payroll tax payments until July 15th, with the possibility of another extension
  • New forgiveness applications were released with a maximum of 5 pages
  • Creation of an "EZ Application" for businesses that didn’t reduce salaries, wages or hours by more than 25% OR any business impacted as result of COVID-19 who didn’t reduce wages by more than 25%
Closure Guidance from California
Department of Public Health
As COVID-19 transmission rates continue to rise, this guidance instructs counties that have been on the County Monitoring List for three consecutive days or more to close indoor operations for certain sectors which promote the mixing of populations beyond households and make adherence to physical distancing with face coverings difficult. Within those sectors, those that are not able to continue their business through outdoor operations must close that portion of their business effective immediately for at least three weeks, in order to further mitigate the spread of the virus.

EEOC Warns Against Age Discrimination
I n its  latest round of updates to a series of COVID-19 Frequently Asked Questions , t he Equal Employment Opportunity Commission warned employers they cannot prevent older workers from returning to work even if they want to protect such workers from the effects of COVID-19.

It's been well publicized that those over 65 are at a higher risk of contracting coronavirus, however the Age Discrimination in Employment Act prohibits employers from excluding those 65 and over “even if the employer acted for benevolent reasons such as protecting the employee due to higher risk of severe illness from COVID-19.”
