Hundreds of Section 301 Tariff Exclusions Extended

As a courtesy to our clients, we would like to share the following message from Sandler, Travis & Rosenberg, P.A.:

More than 300 exclusions from the Section 301 tariffs on imports from China, which had been scheduled to expire Dec. 31, are being extended through Sept. 30, 2023. Importers of covered goods (click here for full list or on the image to the right) can utilize any of these exclusions for any product that meets the description in the exclusion regardless of whether they requested the exclusion.

Exclusions from the Section 301 tariffs on imports from China for 81 medical care products needed to address the COVID-19 pandemic were previously extended from Nov. 30 through Feb. 28, 2023.

In the meantime, the Office of the U.S. Trade Representative is accepting comments through Jan. 17 as part of a review of all Section 301 tariffs on imports from China. U.S. importers, manufacturers, retailers, and others that have been hammered by these tariffs should use this process to press the White House for relief. ST&R can assist in preparing and submitting comments to USTR; for more information, please contact Ned Steiner at (202) 730-4970 or via email.

In addition, efforts to ameliorate the impact of the Section 301 tariffs are continuing.

- ST&R is advocating for the renewal of all previously approved exclusions and the creation of a process allowing for new exclusion requests (for more information, please contact [email protected]).

- There are a number of proven and legitimate ways to effectively avoid the tariffs or limit their impact (click here for more information).

- Importers of List 3 and 4A goods from China can still preserve their rights to possible refunds of tariffs paid on such goods by joining an ongoing court case (for more information, or assistance filing a claim, please contact us at [email protected]).
