LA National sent a letter to HHS last week requesting clarification regarding the legal immunity afforded skilled nursing facilities and assisted living providers under the Public Readiness and Emergency Preparedness Act (PREP Act). On March 17, HHS made a declaration affording legal immunity for COVID-19 countermeasures. LA National believes that the PREP Act provides immunity, but wanted HHS to clarify the scope of the declaration. LA National is seeking additional formal assurances from legislators as well.
Note – LAIN is looking into possible immunity protections in existing state law as well.
