Statement of the American College of Bankruptcy in Support of the Rule of Law and the American Bar Association’s March 26, 2025 Statement

Today, the American College of Bankruptcy issued the following Statement in Support of the Rule of Law and the American Bar Association’s March 26, 2025 Statement:


The American College of Bankruptcy stands together with the American Bar Association in supporting the rule of law and opposing efforts to undermine our judicial system. We support the right of people to have unfettered access to fair and impartial courts, including the nation’s bankruptcy courts. The bankruptcy laws of the United States are necessary to allow individuals and businesses to manage insupportable debts and rehabilitate their lives and commercial interests. Our bankruptcy courts are integral to the efficient and equitable resolution of bankruptcy cases. Access to bankruptcy courts promotes a healthier economy and fosters confidence in the administration of our bankruptcy laws and justice. We oppose any attempts to prevent or limit parties from having access to the judicial system and courts, including the bankruptcy system and courts, or to interfere in the impartial administration of justice, consistent with the law, and our commitment to pro bono service. As Chief Justice Roberts recently observed, “our political system and economic strength depend on the rule of law.”

The American College of Bankruptcy is an honorary public service association of insolvency professionals invited to join based on a proven record of the highest standards of expertise, leadership, integrity, professionalism, scholarship, and service to the insolvency practice and to their communities. College Fellows include business and consumer bankruptcy attorneys, judges and other government officials, corporate turnaround specialists, accountants, financial advisors, academics, and other professionals who are experts in the field of bankruptcy and insolvency both in the United States and Internationally. The College facilitates the effective domestic and cross-border application of bankruptcy and insolvency laws and the administration of justice in the courts through, among other activities, conducting professional educational programs, sponsoring the publication of scholarly reports, and maintaining the National Bankruptcy Archives. The College also funds projects that improve the quality of bankruptcy law and practice and access to justice through grants by its affiliated Foundation, which is believed to be the single largest financial supporter of pro bono bankruptcy services in the United States. Underlying all its work, the College is dedicated to enhancing professionalism, scholarship, and service in bankruptcy law and practice, and to promoting diversity, equity, and inclusion within the organization and across the insolvency profession.
