Dear MLS PIN Subscriber:

MLS PIN has decided to implement rule changes, even though it is still awaiting final court approval of its proposed settlement. Therefore, we can currently accept property listings for sale without offers of compensation.

In addition, to provide flexibility, listing brokers can indicate that they will not offer Buyer's Broker compensation in Pinergy starting in late July. It will be your seller-client's choice.

Compensation fields will be optional and will not be required in Pinergy. You will be able to select from the following: 

• Leave all compensation fields blank as they are optional
• Specify buyer’s broker compensation as done in the past
• Specify “Compensation Not Offered”
• Specify "Compensation Offered but Not in MLS”

For example, if your seller would like to offer compensation but not in the MLS, your entry or edit of a listing in Pinergy would appear as shown in the screenshot above.

MLS PIN will release additional updates now planned for the early fourth quarter of 2024. Be sure to view our latest MLS PIN’s New Compensation Updates PDF for updates and timelines. It includes essential information about the disclosures that the seller needs to make up front regarding compensation offers.

Please remember that no court has yet to approve the NAR or MLS PIN proposed settlements. If the MLS PIN settlement is approved in its current form, all MLS PIN subscribers will be released from claims arising before the date of approval, which has yet to be scheduled. If you have any concerns about antitrust or liability, please consult with your broker or your company's attorney.
