“Existing Construction” Allowed
Per the Governor’s new order, all existing construction is allowed to move forward under the Phase 1 guidance. Thanks to advocacy efforts, CWHBA and BIAW were able to secure a definition of “existing” that strongly favors builders. If you have a project with a contract entered in before March 23, that project likely qualifies as “existing” and may be able to move forward.

For purposes of this memo, in existence means construction activity that is:
  1. needed to fulfill an obligation under a contract effective prior to March 23, 2020, or
  2. authorized by a government-issued permit obtained prior to March 23, 2020

Project Permit Extensions
Did the shutdown push back your project timeline? Are you worried about your permit expiring? Reach out now to your project’s permitting office and request an extension. Most cities and counties have already agreed to provide no-fee extensions to all permitted projects.
