OPWDD Day Habilitation Enrollment Training
As part of OPWDD’s continued work on their Day Habilitation Enrollment Project, the Division for Quality Assurance (DQI) will be hosting a training session on Monday, January 30, 2023, from 2:00 pm-3:30 pm
The training, Day Habilitation Enrollment Project and Moving Forward, will include information related to:
- The current status of Day Habilitation enrollments.
- A discussion of enrollments, disenrollments, service authorization, and Notices of Decisions
- A review of the contents of the Day Habilitation Program Code Change and Service Plans memorandum issued on December 21, 2022.
- A review of the current requirements in ADM #2006-01.
- Best practices related to updating service plans, to be inclusive of Day Habilitation services moving forward.
This training will be conducted using Webex Webinar and is intended for Quality Assurance staff, Care Managers, and Day Habilitation administrators. Please click HERE to register for this training.
OPWDD HCBS Settings Rule Training Presentation Now Available
The training, Enriching Individuals’ Lives Through Choice and Inclusion: The HCBS Settings Rule, provided on December 15, 2022, is now available on the Statewide Learning Management System (SLMS).
This training addresses several areas of importance to the Settings Rule, including a review of OPWDD Regulations, non-institutional vs. institutional practices, person-centered services and informed choice, the roles of care managers and Care Coordination Organizations, as well as the role of habilitation providers regarding the Settings Rule. The training also covers examples of deficient practices and strategies for long-term and sustained compliance with the Settings Rule.

HCBS Settings Rule Town Hall
NYC Fair is also hosting a Town Hall to discuss the HCBS Settings Rule on January 26 at 7 PM. Katherine Marlay, OPWDD Deputy Commissioner of Policy & Program Development, Megan O’Connor-Hebert, OPWDD Deputy Commissioner of Quality Improvement and Beth Haroules, Senior Staff Attorney of the New York Civil Liberties Union will be present as panelists. Annual Compliance Program Certification Requirements
The Office of Health Insurance Programs of the New York State Department of Health (OHIP) has recently released the December 2022 Medicaid Update. As part of this Update, OHIP included a reminder to Medicaid providers regarding their responsibilities to adopt, implement, and maintain effective compliance programs as indicated in New York State Social Services Law §363-d as well as corresponding regulations in 18 New York Codes, Rules and Regulations Subpart 521-1.
The Mandatory Compliance Requirements Update also reminds providers to certify their compliance program upon enrollment and annually by using the eMedNY/Medicaid Management Information System – Certification Statement for Provider Billing Medicaid form (EMEDNY 490601). This form will be included in materials DOH will mail to the provider approximately 45 to 60 days before their enrollment anniversary.
OHIP also reminds providers that a failure to adopt, implement, and maintain an effective compliance program may result in sanctions or penalties, including, but not limited to, the revocation of the provider's agreement to participate in the NYS Medicaid program.
